Attorney H. A. Allen counsel for DuPre. told Judge John Ii Humphries conducting the hearing Gordon had nude the affidavit and had promised to be in court last Friday to take the stand. He had suddenly disappeared then.

He was in my of. tire not an hour ago said Mr. Allen and had been properly subpoe. naed and told me he would certainly be here but it seems that he has disappeared again. I therefore withdraw his affidavit.

But I want him in court. insisted Solicitor-General John A. Boykin. Let an attachment issue for- him ordered Judge Humphries. Find him and hold him until I return here he ordered.

The commission was turned over to Deputy Gordon Hardy on the probable theory' that it takes a Gordon to catch a Gordon Richardson on Stand. Previous to the Gordon incident. E. L. Richards Who had' made an affidavit as to having heard Juror Howell express prejudice was called to the stand.

Solicitor oykins cross- examination was evidently directed at proving that all the affidavits had been obtained by one evidence collector who had not been particular about their accuracy. A fourth juror was brought under fire when C. S. Park. of Smyrna.

testified that Juror J. L. Brannaq had told him previous to the trial that he thought DuPre should be hanged but expressed doubts it a jury could be found to return the death penalty. The hearing adjourned after Attor- fey Allen had reserved the. right to any jurors that might make affidavits to be produced by the solicitor-general.
