On- May' 22 last year. Mr. Painter had a violent fit of coughing and vomiting while crossing the St.

and sent to Baltimore for analysis. More than 1000000 insurance on' his life had been' taken out' by Mr. Painter a few months before his death. On April 21 1913 the United States Fidelity and Guaranty- company is sued him an accident insurance policy for 20000. The policy excluded suicide and provided that the company should have the right and opportunity to make an autopsy In cast of death Having been refused the privilege of making an independent examination of Mr.

Charging. that there are certain ir regularities to be corrected. Mayor James G. Woodward Is sending veto messages to-the general' council to de ft the proposed contract with. the Cement Stone and Tile company for laying all sidewalks passed up ty the street committee in 1914.

According to estimate the. tract will amount to between 76000 and 100000. Mayor Woodward explains that he believes Alderman John S. Owens of the eighth ward is' a stockholder with W. Z.

Bishop In the Cement Stone and Tile compcCTi end declares that. if such relations 5st the contract is illegal for the reason that the city charter prohibits the ctty from entering into a contract with a firm partnership or corporation. in which the mayor or any member of oountll is directly or in directly. City officials see in Mayor Wopd- wards message and the reply of man Owens. the. beginning of a bitter conflict. The eighth ward alderman declares that he recognizes the mayors power to veto the resolutions. but It is not in his power to make falsehood out of truth he.

Mayor Woodward has also vetoed a number' of resolutions authorizing the laying of sewers and of sidewalks on certain streets He declares that on some of the streets there are no dwellings He also. rltlcises Councilman Jesse B. Lee because of his' activity in having the resolutions passed up. Mayor Woodward has also vetoed the resolution authorizing the sale of the old Edgewood IJgMla plant for 4rSOO.

He calls attention of council to an offer from Attorney C. P. Goree repre venting a big oil mill. to give the city 5000 cash for. the property or in the event it' is offeredat auction to start.

DAI vlgney. streets. and according to' the estimates furnished me by Captain Clayton. it will' cost the city of Atlanta about 1500 to lay the sewer on these three streets where thfOrels no water yet there are tour or five' times more houses on the streets where there tlms more house on the streets where there are no water mains than' there are on the streets where water mains are located. I desire to again try to impress upon the members of the general council to not pass up any more sewers on streets where' there.

Lee. the street committee not taking any action at sit. I also refer your honorable body to resolutions marked. as offered by the street committee putting tile sidewalks' on Palnes avenue north side of UeKalb avenue. on Corner street.

on Royal. street. on McMillan street. on Glenn ood avenue and on Eighth. street.

None of these resolutions is signed by. the street committee and It is questionable if assessments for this work could be collected. as. It. Is.

evident no" one. by their signature. desires to become responsible for It. This Is a very Irregular way of pausing up matters of this character. White I have not disapproved of this work.

yet I desire to call the general councils attention to It and have' the waiter referred to. the street committee. Let me. in connection with the sewer. and sidewalk ork.

Impress upon the members of the general. council the fact that we should be very carefulIn proceeding with such work. that. the people have to pay for by assessment. Attacks Alderman Owens.

I Following Is Mayor Woodward's veto of the Cement Stone and Tile company I return to your honorable body without my approval the following contract granted to Cement Stone and Tile company 17. Z. Bishop president. Contract for. group No.

I for the building of sewers the. combined length of which is approximately two miles Contract for' tile sidewalks sheet cement sidewalks and sheet' cement driveways. Contract for cement tile and replacing condemned sidewalks and. sheet cement drive ays. Contract ton granite sad concrete curbing.

tarn constrained to this action under section 100 of. the' legislative part. of' our city charter which says It shall not be lawful for any member of the general council to he Interested either directly or indirectly. In any contract- with the city of Atlanta the mayor- general council or any one or more of them. having for Its purpose the pub.

lie Improvement of the city or any part' thereof or the expenditure of Its. moneys. Arty violation of this section by any member of the general council. shall on conviction thereof be punished as described In section 4310. of the Code of this state.

After going very thoroughly in the matter of these contracts. I am firmly convinced that this section. of the' code Is. at tempted to be violated. When these matters came.

to my attention. I called to my office Alderman Owens and Sir Bishop know- Ing that they had. been In partnership and owned the Cement Stone' and Tile company prior to the present year. I felt It. my duty to Investigate the matter.

see what the present status of. the' company was. In the interview Between Alderman Owens and' Mr. Bishop Hth me learned from those two. i themselves that the Cement Stone and company was a stock corporation but ow practically by- the two men themselve and while there was presumably- a sale bjJjAlderman Owens of his interest that sale.

such was the case does not relieve Alderman Owens of the conditions of that section of our charter. Alderman Owensstatement to One was that he and Mr. Bishop were equal owners of the stock that. Is each held the same amount. and that in snaking.

this trade to presumably avoid- the violation of the quoted section of the code. he made a sale agreement to Mr. Bishop of his entire. stock ant took the stock of Mr. Bishop as collateral security for his debt against the Cement Stone.

and Tile company. It Is perfectly evident' to. my mind that this is not an Indirect but a direct violation of the' law. Alderman Owens. as I stated to him personally.

Is obliged' to be. Interested. In" the success of that. company In order that. It should net deteriorate in value.

thereby weakening the price of his collateral stock. In other words. it the Cement Stone and Tile. company did not get sufficient work and prosper. Alderman Owens would be greatly the loser thereby.

The sum and substance of this' trKSjsgg tlon in the. disposition of. the Cement SfofSfc and Tile company seems to. be a. case of just simply swapping stock and that for.

alt practical purposes. Alderman' Owens Is as much Interested In' the Cement Stone and Tile company under present as as he was prior to arty agreement of sale. I do not wish' to appear harsh In this matter. but it would be a. matter of Impossibility for me to sign any contract or allow any of the city a money to be paid out upon any such contracts until the same had been passed upon by.

the courts. And while I do not wish my remarks to appear personal or offensive nor altogether appealing to this one case. yet I must protest against such conditions. it contracts of this kind are allowed as a precedent. it simply means for the future graft.

WOODWARD Mayor. Alderman Owens' Reply. Alderman Owens made the following reply to Mayor Woodward's- message I notice the mayor saYs that this contract la Illegal cause he is Informed I own sonic stock In this company. I do not believe the mayor can indicate anyone who has told him that. I owned any stock' in this company when I took the oath of office or that own any stock in same at this time.

What he has been told I am persuaded. he got from. myself and Mr. Bishop. Both were preset.

and both concurred In the following statement. namely that I was owner of one-half of the stock of the Cement Stone and Tile company and when elected to the aldermahic board. I decided that It would be better for me to dispose of this stock so as to be relieved of any possible criticism In the event this company should. be awarded by the general council any contract for publlcwwork. Ac.

cordlngly I negotiated with Mr. Bishop for the sale of this stock and after some time was consumed In this negotiation agreed upon a price. Thereupon I transferred to him my stock absolutely' and without qualification. He took this stock and. had.

It transferred to him on the books of the company and had. stock Issued to' him in place of this stock and this tock so issued. Is now In Ms name. In order to secure note given to me for the purchase money title stock. was attached to same' as collateral security.

This Is' the whole story. I no more own' this stock now than' a bank owns stock In a company to whom It has loaned money and. as collateral. security for' the loan. it' has had the stock deposited.

with It as a col lateral. This matter has been explained to the ma or and he must understand It fully Of course. It Is In his power to veto the contract. but It Is not in his power to make a falsehood out of the truth. His statement that I sin Interested In any way In the contract is untrue.

and I believe he knows It and. notwithstanding this knowledge for purposes of his. own seeks to attempt to do me an injury and. as a Justification therefor to mislead the people. The mayor' might be moved to some extent.

by. a desire to come to the aid of some of his pets in the city contracting business who lost' out on account of their higher bids and Is using this as his only method of giving them another opportunity to' bid again. In this connection. It might' be well has posed as a friend of the people and on ery careful of their Intererts. to vetoing I contract which will save them taking Into consideration the- next lowest bid.

Atkinson. lie. la now working for this company or the receiver of this company. He is receiving II. salary from this company and has received a.

salary from this company for years. His supposed business Is to collect rents and look after the propertyand for this. ke said to receive Quite' a snug little salary. Now. working for this realty company is not "directly" working tot the.

street car company or electric. light company does live him Indirectly" connection with these interests because- both are controlled by Mr. Atkinson or his associates. Therefore it the mayor will be consistent In his ruling. he will the contract held by the city with the electric light company and the team heating company void because he.

Is Indirectly working for the Atkinson interests. For many years Past. when. you wanted to see' Mr. Woodward.

you would go to the Cmpir building. which la controlled by the Uklnson interests. and look for his office. ftrhlch Is very near to the attorneys for th 1 Atkinson Interests and the whole atmosphere for years put has that of Atkinson. It ill becomes him' to- seek to raise this point' with me after I have purposely and distinctly disposed of my stock.

Secretary Garrison was. sent a telegram by Governor Blease today re iterating his willingness to have the war department head issue ant order authorizing the holding of the encampment at the Isle of The action of Secretary Garrison In dealing principally with. Savannah Ca. April 18. General Manager Morgan. of the Savannah and Northwestern railway whose conductors are on strike. tonight confirmed the report that train No.

3 had' been held up by A mob at llllltonla near Sard Is and. the engineer and conductor carried ort. Mr. Morgan' emphttized the. point that armed force" had been used In capturing the train crew.

He said that a posse was being sent out to' night from Sylvania to rescue the trainmen. He also notified District Attorney Akerman of the affair anL that the. train carried United. States mail at the time it Was held up. A strike has been In progress on the railroad for several days.

ATTACKED BY UNKNOWN AND ROBBED OF MONEY E. F. Harris wino resides at. 278 Central avenue was attacked last about 12 o'clock near his home by an unknown person and robbed of 25. Harris was struck from' behind without ever seeing his assailant and says he knew' nothing of the affair until he regained consciousness In the ambulance on the way to the Grady hospital.

At the hospital the doctors said his condition was not serious. His' head was bleeding freely and his elbow had been knocked out of joint. His. watch was not. taken.
