AUEMAABLE STORY. ran youxo 1111 JZElrlrD TO jsvxotiari nt6AXE. JE' IS J. H. DOWNS OF CARROLL.

I from Custody and Wi Family Raft en Unble to Hear From mm Until I Arrested CotlfeMs to the and Implicates a Young rJlIICWL One of the mort remarkable stories to th rlminal history of Georgia wai told yesterday Justice court. The central figure in the strange story th young win who was arrested Sunday mornln lor burglarizing a doctors office on Decatur ttreet. The ouuz man gave his name Dr. Hear Davis. lie is not a physician.

He is not Henry Davis. lie is J. II. Downs of Csnoll coucty. And he believed to bf insane.

Another feature of the story and ft feature that premise strange developments of its own the strut of Dr. J. T. Herndon as a party Ute burglary. Davis or Downs confessed the burglary saying that he had paid a negro 5 to break open the door.

Then said lie I went in and took the instruments myself. Dr. on arranged i ill through lid the understanding was that we were to divide the goods. We did dl. ride them suet like we had agreed to do.

Dr. Iferndon was arrested lid Judge Lanhum bound him over to newer the charge II in the city court. Down. History Downs the insane man that stole the goods Is 27 years of age. His father i JudSe J.

W. Downs of Bow den Carroll county. The old rentleman was Ii brave a soldier as there was In the confederate army and since the warhes been I hardworking prosperous farmer and i man of considerable influence in his county. The family are all well-to-do and highly respected. Young Downs married made money at his trade of wagon and carriage making.

and In 1885-0 was mayor of Bowden. No young man In Carroll county had brighter prospects before him. In the latter part of 1886 the young man began acting strangely. He seemed to lose all affection for his wife and family. He neglected his business and finally sold it at a sacrifice and against the urgent remonstrance of hi father.

Then his wife became afraid to live with him. Three children all boys had been born to the young couple. and often the mother would take her babies and run away from home for fear her husband would till them. Finally the young mans father took charge of him. All that parents and relatives and friends could do was done for the young man but despite all this his condition grew rapidly worse.

and on the first of April 1887 Downs was BEST TO THE UYLUM. He remained there until December 17 87. Then his father was allowed to' take the young mm tack home. Downs was not discharged from the asylum but simply released on furlough. It was hoped that home associations and the companionship of his wife and children would benefit him especially as he himself begged continuously to be sent back home.

The return home did not have the effect in tended. Downs refused to see his wile and secfced to have lust all natural affection for his parents and his children. HU condition grew worse so rapidly tilt his father was compelled to lock him up in his own room. The young man we a physical as well as a mental wreck. His melancholy took a desperate turn eventually and sin ATTEMPTED SUICIDE by swallowing two ounces of laudanum His escape from death a narrow one.

After this he made repeated efforts to kill himself keeping his family in constant suspense and dread. lie tried to km himself with a gun anti again with a razor. More than once he was caught eating matches. Night and day a guard was kept over him. Time and scam the insane man made efforts to escape resorting to the most ingenious devices and persevering with an energy and courage that a sane man could never have displayed.

Twice he succeeded in escaping from custody. The first time he was lost for two days. and the fAwHY and neighbors searched night and day expecting nothing better than the recovery of his body. llejwas found on the edge of a millpond with his Lat shoes coot and vest off and a rope in his hands. He was coolly preparing to weight himself down and drown in the creek.

The second time he escaped he was out for seven days in the woods. During that time it reined almost incessantly and the madman was without food or shelter. lie was found completely prostrated by the hunger and exposure lying in the woods and unable to move or call. Finding that It was impossible to keep his son In safety Judge Downs wrote to Dr. Powell superintendent of the asylum in Milledg villo that he was coming to toMilledgevilla with his eon in custody.

That night DOWNS ESCAPED. Again a search was made and for a month afterwards parties would scour the woods for miles around Bowden. Descriptive circular and telegrams were soul all over the southern states but no trace was found. On Ui 20th of November. six weeks aftea Downs had disappeared from home.

to young man named G. W. Little stopped at Lnhonia. As he stepped into tho front door of the hotel he fac young Downs. Whybelio Downs.

He ld out his hand in greeting to his friend. Downs tarn lid ran without A word In reply. Word was telegraphed to Judge Downs sod he used every effort to trace his son. Agalu the young man had disappeared and left no trace behind him. is JrLAo About three months aro Downs came to Atlanta.

He tried 101 Decatur street and placed Himself in the hands of Dr O. W. Bxnchmanof New York proprietor Cherokee Indian remedies whose office was next door to So. 101. Downs always had plenty of money so Dr.

Baaghiuan says but seemed to have no regular business. After staying here a month Downs still calling himself Henry Davis moved into the office with Dr. Joel F. Hammond on Peachtree near th junction of Broad. He went as a patient of Dr.

Hammond. A few days aft mo. in there a strange circular suede tie appearance on the streets. It was headed Dr Ism with Joel F. Hammond Health I Wealth.

The circular was two-thirds as largo as a of the Coxsrmmox sad the reading matter was arranged in columns like a. newspaper lid broken up into head The circular was worded in plain vulgar suggestive feeble. It was obscene. Further ow falh thsjiaserDowni was referred to a Professor Henry Davis just from the Indian Territory. Can tell jour fortunes.

Can tell the past tA the future. Downs worked incessantly. Whets was not attending to a. patient he down at the toot of the steps distributing the circulars. As late is 11 o'clock at Bight ho would stand there chattering with the cold lid his limbs trembling in a lsy like fashion txculUr to tt physical disease that had destroyed his He attended to Urn lelou pie that came to him for to new to a and wfll benentbacV faj MiHedci Villa toon the nxtMarfftfcn can I pad out Dr.

ITanuandYIart Dr. Ilamnoad wrote the circular. lie stated to a Coaitminon reporter liu Teninc. Four day ago there were tho circulars in his office. Last night the were ll gone.

Pressed for an explanation 1)U connection With Downs Dr. Hammond road. substantially the following statement kvDavU offered meLTO for tbeaseof ray earn lid influence. I consented. lamsorryldi it.

but I did. He did not pa me the mone be promised Did you know be was crazy T' never suspected it until. a week or te dan ajto. Be ft insane but htr the harped fellow I ever saw. He could snake mone where a ground squirrel would perish.

Ton think he crazy now Oh no doubt about It. I aware that court this morning. There Utile doubt of this now. but a moe peculiar and unusual feature of his insanity i nil mauls for mating money and his success li making It. He is miserly to a degree seldom teen.

The books show that this insane man with absolutely no experience as a physician. an without friend in Atlanta came here an made his fake practice pay him nearly 8200 i month. He is a complete physical wreck aa he is insane. But he made 200 a month. His idea about posing as an Indian doctor wee doubtless borrowed from his experience with Baughman the Decatur street man.

Besides the 250 offered Dr. Hammond for the use of his name Downs paid the office ren for two months bought tome office furniture lid has in fact. snot an the current expenses. A Theory. The evidence against Herndon is that wont into Dr.

Hammond's office and sat down at the table. Mr. L. J. Daniel will sweat oday that he saw Dr.

Herndon take from his pocket. a Jackage about an inch' thick anc eight inches long. This was wrapped up. My. Daniel will also swear that after he had sat at the table a while Dr.

Herndon picked the package from the table and exclaimed as though he had just seen it Hello what it this It was a pair of tooth forceps Identified subsequently of the property of fiaugbman. sow suppose the forceps were there when Herndon went to. Suppose he found the package there on the table and exclaimed a he saw it for the first time Hello what it this This is not intended as a roundabout way of saying that Herndon innocent and Dr. Hammond guilty but Davis or Downs was in the office with Dr. Hammond.

Downs was a weak tool in the hands of whoever chose to exert any influence over him. It has been for some time the wish of Dr. Hammond to go west to Texas or the Indian territory and a dayor two before the burglary he remarked that he had made up his mind to go west and was going to get up a lot of instruments and leave here. He has a brother that killed a man in Atlanta bout the close of the war. That brother is now is Texas and doing well and has for some time past been advising Dr.

Hammond to come to him. Davis or Downs was in love with the scheme. He was too near home and liable to be recognized at arty minute. He had seen Captain Couch passing. and remarked one day that the captain knew him when he was a boy and he was afraid to pass the captain on the streets.

Downs wanted to go west. They needed a lot of Instruments. Downs steals the instruments and eretB caught. Mr. Daniels testimony may or may not be explained.

Herndon may be guilty. And he may not. THERE WAS NO INQUEST But Quoenie Worthy's Brother Will Pursue His Investigation Qucenie Worthy's death is involved in mystery. The mystery is no nearer solution than yos- wrday. After talking with several witnesses Cor- oner Avery decided not to resurrect the body but advised McNeY' to have Worthy appre.

hended and broTxbt before a justice of the peace so as to bring out the testimony in the case and then if the evidence was of such a character as to demand an inquest the body euid be exhumed and an inquest held. McNey went to Judge King and had a talk with him in regard to theuaatter but Judge King was of the opinion that MoNey had best fully really before entering into such a case. McNey then went away to prepare himself more fully to deal with the matter before taking further steps. Dr. Avery had a talk with the older of the two women who roomed in the apartment adjoining the one in which Hams.

and Queenie Worthy lived. and this woman corroborated thu story of Ramps failure to assist his wife when she found herself on fire. The case promises some interesting develop- ments before it Is through with. Mr. Loekhard Dead.
