After the reading of the Journal this morning- Mr. Hall rose and said Mr Speaker I was unavoidably absent yesterday when the tote was taken on the resolution declaring colored persons ineligible to seats on this floor.

I belieye sirunder the Constitution adopted by the Tate Convention of the people of Georgia which was composed almost entirely of Republicans the negro is not entitled to hold office. Believing thisy sir it is my dutyunder my oath to support and defend the Constitution of the State of Georgia as welt as under my obligation to my coun try my race my kindred and my God to vote for the resolution. I desire to record myrotd ya. This action presents Mr. Hall in a new light and we unhesitatingly place him among the true' men of the country- and beg hij pardon for having doubted his patriotism.

Thirty thousand voters are watching with anxious solicitude to ascertain whether they have been Invested with full political. rights In Georgia. It Is really ft-aught with interest of the greatest magnitude to both the white and black races of our State and in order that.

I may appear properly upon the record as I know that unborn millions will crntinize our every action. and avoid all misrepresentation in regard to the opinions that entertain upon tliUsubject I have reduced them to writing. I will say In the begluing that I do hope that every member In this house will act from conscientious conviction of duty in voting upon It. If I believed that the colored member were entitled to their scat under the Constitution I would opix time resolution let Uie consequences ho they may. for I would nut perjure nivsulf the highest office in the gilt of tim 100 pie The people of the country ilcdire a settlement of this question anti the Constitution has made it obligatory upon each branch of the Generii Assembly to settle it with no appeal.

During the period known as the Imrk Ages we are taught that it va not unfre quently the case when the barbarous uncivilized nations of the earth engaged In warfare.

It i very clear and I re gird it as a well settled principle that the act creating them citizens did not give them all necessary political rights but these rights must be specially conferred law before theycan be exercised and Congress has passedno law giving them the right to hold office la Georgia. You wilt find that the 2-1 section of the Declaration of Fundamental principles declares that all persons born or natualized in thn United States amid resident In this State are hereby declared citizens of this This section makes all persons with the quaUiication therein Specified irrespective 01 age color or Sex citizens of this State and declares that It shall be the duty of the General Assembly by appropriate legislation.

You here discover that the simple act of conferring citizenship upon individuals-does not carry wltljit the right to vote and to hold office. If such was the case the female. minors and all other persons without regard to color or crime would be al lowed to vote and be eligible to office In our State which the framers of this Constitution did not intend. For we find In section 2d article 2d the statement that every male person In the United States and every male person who lia been naturalized or who has declared hi- Intention toecomea citizen 01 theUiiltm1 States twenty-one years old or upwards who hall have resided in till State lx months nest preceding the election and thirty tItys in the county In which lie offers to vote etc.

There were no negroes to the Convention that made the Constitution. and the author of the Declaration of Inde pendence who wrote that all men were ual was an owner of slaves and when ledrew up the Constitution which Wa afterwards adopted with amendments by the thirteen colonial States- he provided for the protection of the institution la that instrument the negro could not have then been recognized as a party In the formation of this government. It Is a well set- tied awl conceded principle that ill nations nave the right to prescribe the conditions of citizenship to men of other na tl ns as well as their political privilege and. I maintain that unless that right is specially conlcrred by law that It cannot exist whether the Individuals have been brought Into this country or carried Into any other by voluntary or Involuntary ac lion. If a foreigner and his posterity should remain In this country ten thousand years they could have no rights un- they are given by the fratftur of the government or their legal descendants.

The negro WM brought Into this country by Involuntary action which cannot effect his status he was sold a heathen stave. Ins children generation after generation were born slaves under the laws Of time State with no political rights under the Constitution of the United States for the Supreme Court has long since settled that question. Consequently he can have none by Inheritance because he was not a party in the formation of this' Government and can onljf be adopted' a heir by express warrant Constitution for no law Is valid unless the Constitution authorizes its passage. This only shows the tboininuble envy and malice that lurk in his corrupt heart towards the people of the South-and not the love that he has for time colored man.
