Two years ago ttld Mr. Shubert In explaining the origin of tm spute wo tiened a contract with the theatrical syndicate which is headed by Meur Klaw Erlanger agreeing' that the syn dlcate could book their attractions our houses for 25 per cent of the pronu for a. period of years. After we lad elgned this contract a letter was sent to us by tile syndicate asking us to amend the contract by agreeing not add any more theaters to our own elt- cult Mr. Shubert says tha at this point he had only eight theaters In his own dr- cult and did not feel strong enough to make a fight agalnflt the syndicate.

When I asked Mr. Shubert continued why this new amendment was required I was told that our company had violated its contract with the syndicate by refusing to accept some of their attractions which they had booked at our house. They raid that this was a violation of our contract with them. though that document contained the provisions at the syndicate attractions were at all times subject to our orders. After this eon- creation the matter was allowed to rest for a time.

Meanwhile the Lyric Theater Company was extending i own clrcul4 and acquiring new attraction' When our company was building the Garrick theater In St. Lout the syndi cate told us that we would not be al lowed to book our own attractions in our own houses It we pi rsued our policy and yet. at their convenience they al ways Sliest their theaters with our attractions On my return from Europe lat Jun. 1 was tent for by Mr.
