The three went to gether to the blacksmith shop.

and having lighted the lamp brought front the house the white man entered and smeared the hammer. They went neck to tbe house. They decided uot to use the sledge- lf. hammer. The white roan told him to go and get that axe.

He refused. The ed white man and the other negro cursed him. nd He then went across the road and procured tbe axe. The three now entered the home. The white man took the axe and murdered the old people while he held the-light.

The other negro watched at the back door. After the tilling he placed the lamp on the bed where it was found but not with ft to burning the house. The PRESIDENT appointed as a commit tee on the-part of the senate to act with a committee on the part of' the house to confer with the city authorities of Atlanta rel itive to the selection of a site for a new cap etc. Messrs.

Zviraia and GUISE. The senate resumed its unfinished busi nessj which waatbe contideratlon of the re port of- the committee appointed to Invest gate the conduct and motives of the govern or in signing the bonds of. the northeastern railroad. Mr. BRYAN had the floor and continued the debate.

Mr. GRIMES said he was opposed to any action on this matter by the senate. He was also opposed to the substitute of Mr.

BOWEB. He would offer a substitute for the whole. He thought the governor made a mistake in caking an investigation but it was a most pardonable error. We made an error in granting the request and now that we have found itontwhynot remedy it He did not deem the report full enough. It only touched the question of bribery.

Ji said nothing of the propriety legality of signing the bond ThisVasone reason why Tie should oppose It lie opposed the iojbstltnte- of Mr. Bowes because it com uted the senate to some action on this matter. Why. act at all For vindication of the governor lie has already been vindi cated by the house and- by the people. What more can he want We ore a court and we sit hero to-day in the same capacity as if we were trying the gov rnor on articles of impeachment.

By acting on this matter we disqualify our selves just as a juror does who is proven to have expressed an opinion on the case he has been irnpanneled to try. Action on this report is either unconstitutional or if it is not that it is in bad taste. All sena tors who have spoken have admitted that the senate erred in appointing this commit tee. We cannot remedy that error by mak ing another and adopting this report. I ant not ready to take that second step of error.

Mr. GRIMES then offered a resolution as a substitute for the whole. ft was almost identical with the resolution which Mr. UUMXLKQ ouereu last weex to rue euecs was th senate had nothing to do with the se- portas it was only a court of Impeachment. Mr.

STEPHENS said the real question in its last analysis was whether the governor of Georgia received a bribe or not. We have read the evidence in full and after six months we come back' here. The con tisution has not fully prescribed our duty or propriety on such acase as this but whets we say on a charge of this kind guilty" or not guilty the moment we so then we destroy thr dignity as the highest court of trial and. the Impartial tribunal for Use trial of all Impeachable officers. We are but human anc by' committing ourselves once on such a question we will warp all subsesuefll judgment We have notgone top far.

This committee has considered all the circa stances of this case and has recommended the passage of a law to preVent clerks in stats offices or state officers from taking fee. It is our duty to pass such alaw. It is sale that we owe to the governor the adoption ol this report as a duty. I do hot think so The governor had no court in which to vin dicate himself. We sent out five senator we paid the expenses of the court we sen for persons and papers ire furnished him a court in which to vindicate himself we ea re him a court of thirteen enduch nor a judge anu a jury.

That court found nothing against him. His vindication has one out to the country and nothing that we con do will add to the strength of that vindication. Mr. DvBOSll said the question was plain. It had been argued that the senate had no right to act in the matter.

The hour of eleven arrived and for' a hour the special order w' wsa1ai1ltoprohjbit lobbjjpg. Mr. GRANTLANp movedthe cia order until the matter under discussion be disposed of. Mr. McDANlEL offered an amendment that the special crder ba discharged until to after the reading of the journal.

The motion as amended was passed. Mr DuBOSEcontinued I believe the senate has acted with due tahtion add proprity in fivery step of matter There was precedent for much. action. The legislature appointed a committee to examine the administration of Bullock another committee to investigate the lease of the state road. But there were no precedent there would be no difficulty in the way here.

There is nowhere an apprehension that an impeachment process can eyes be brought against the governor in this matter.
