Fortunately the fundamental law about which the complaisant in blissful ignorance prevents this and places all on an equal footing but this request opens up to view the danger to the liberty of the press if the hand. ling of the reports were left to the officers or the ernployes of the political party. The passions end interests of party constitute a dangerous basis upon which to rest the but mess of the newspaper press of the republic.

Anyone familiar with the difficulties in the way of tracing in delays blunders and omis sinus in handling the press busineu will understand how futile a legal enactment would be to protect the press against partisan interference. The frequent expediting of a report to one or a delay to a very important piece of news at a critical hour by magnetic disturbances atmospheric influences to another might prove fatal to an opponent. The success of newspapers depends in a measure upon time in a case of news almost upon seconds of time. Complaints" re made because the members of the associated press choose their partners and don't throw open the doors to every new corner. What private business is conducted on that principle Does the dry goods merchant divide the orders of his commercial agent with his neighbors Does a broker supply comp ting brokers with his private dispatches and yet it has been gravely suggested here that this privilege be applied to the associated press business as distinctly private others.

1881 the people of the quiet littfe town of Eiyerton in southwestern Iowa were engaged in their usual pursuits when two horsemen coming from the south rode up behind toe bank of Paverton where dismounting they tied their horses and pro ceeded to the front door of the bank which they entered. One of them was as murder- ous in appearance and as fearless as either of the James boys and at one time belonged to their banditti. He was the notorious robber Polk Wells. His companion was perhaps less daring. but equally desperate.

Wells offered a 5 bill to the cashier Mr Sexton asking to hart it changed and. when the cashier turned his head for that purpose the second robber aimed two 44 caliber 8 inch revolvers at his head and held him there while Wells sprang over the counter and in a moment hid placed the cash in sight 4 GOO in a sack. Toe two then compelled the cashier to walk with them to the back of the bunk bringing four revolvers to bear upon him. Reacning their horses they mounted and rode out of town firing back with reckless indifference to in timidate my one inclined to pursue them. They were traced to Dubuque Iowa where he op ned a hotel and where Sheriff Daniel Farrel 1 followed them.

Farrell asked him if he was Mr. Warner. 1 es said Wells as he instantly leveled the murderous weapon in the face of the intrepid officer. They were standing close together at tins time and Farrell had taken the precaution to draw his revolver and hold it cocked in his overcoat pocket.

The desperado confidently expected that the officer would say he did not wish to see him and ca speedily as possible beat a retreat There are but few men who would not have done so. Farrell notwithstanding Inc was at the of of having his revol. ver in his coat pocket while that of the man who would take his life on the instant ho showed fight was cocked in tile face still thought he had an even chance and he acted promptly. Striking the pistol from his face tie drew his own and then one of the most terrific struggles ever known to kill his man and save himself began. Wells's shot just missing rrell took effort in the door casing beh nd him. Farrell's shot took effect in Wells's a lett breast passing under the breast borne and lodging in tOe right side. Tars wound did not in tne disable him at that time. but he leaned hack a en into the dining room with Farrell following close to him. Both fired again each trying to avert the shot of the other.

Farrell's shot took effect and made a slight scajp wound but did not penetrate the skull. ells shot was turned aside by a blow from FarreL By this time the two men had closed and Wells kept backing around the room each in the meantime struggling to get in a shot and at the same time hold the weapon of the other. As they struggled through the room they knocked over a stove in which a hot fire Will burning. They broke table chairs and dishes. Finally at they were passing by the stove and it was knocked over.

Wells threw his. pistol arm around the pipe and fired hitting Farrell in the back of the head. The ball passed across the skull under the scalp. This shot for a moment paralyzed Farrell and carried him to his knees and he lost his revol. ver.

Justas Wells was drawing down on him again he had recovered and sprang arid clinched Wells as his only hope for life. The shot of Wells went into the ceiling and Farrell threw him heavily to the floor and as they lay there Fdrrell seized Wells's revolver and struggled for OIISeStiou knowing that it Will death to the- man who released his bold. In the conflict on the floor they moved along until they came within reach of Far. rd's pistol which he immediately seized but before he could fire Wells also seized hold of it with his left hand. and there they fought Wells holding Farrell's pistol with his left and his own with his right hand.
