Every member or the county commission Is in favor of this method.

so it is more than probable that this year will see the beginning of a. new Jail. The present jail. especially In the winter months Is a. perfect black hole.

It is in worse condition now than ever years ago the grand Jury declared that the jail was too small and was absolutely unfit for human beings to remain in. The report was exceedlnly complete and pointed out the various defects in the sanitation and the building proper. The county commissioners took it up but no action was taken until about two years ago. An effort was Tnade to put out bonds but the people- did not want the money raised in that way. In the meantime the various grand juries visited the Jail and found that Its condition was growing worse and worse.

The re ports showed the jail to be In a. condition bordering on horrible. Money was appropriated by tile commissioners to remedy a few of' the most glaring needs and It was patched up. Other grand juries came along and denounced the jail as a. disgrace to civilization as a pesthole as unfit for oc- cupancy.

A second effort was made by the commis. sioners to have a jail built by the bond plan. but again the people failed to vote the requisite two-thirds majority in favor of the In the meantime. four years from the first report. Fulton county has increased In population at marvelous rate and the Increase in the number of criminals has corresponded.

The Jail was built twenty-live years ago. when there was about 40000 people In Fulton county. Now there are at least 10000 people. The population has nearly quadrupled itself but the accommodations for the prisoners. have not been changed except by an addition which is given up entirely to United States prisoners.

It is not the end of the law. that because a man Is ac cused or convicted of II. crime that hit is to be treated or abused or that he Is to be confined where his life will be In jeopardy on account of the unhealthy his place of Imprisonment. Soon after the bonds were defeated. last year the condition of the jail' was such i that the county commissioners had to appropriate another sum of money for patch work.

This bettered the condition but little. and the grand Jury reported again that the Jail was unworthy of Fulton county and should be torn down for another and better one. The county commissioners the old board were every one in favor of a. new Jail and thought that the most desirable medium would be bonds. An election was to occur un January 2 1894 and they declared for another election on the question of jail bonds.

before toe peoples The result of the bond election on last Wednesday Is a matter or record. The bonds did not receive sixth of the registered vote. Slow the Defeat Is Construed. The county commissioners do not construe the vote on the bonds as moaning that the- people do not want a. new jail.

The new jail Is a necessity and the vote against the bonds does not remove that fact. The vote was not. one for or against a new Jail. There has. not been dissenting voice to the proposition that a new jail is necessary.

Thtre are two methods' by which money for a new jail could be raised and of these were open to the county commission. era. One was through the medium or bonds and the other by a direct tax. The bonds could not be issued without first giving the people an opportunity to say whether or not they wanted them. After the question was thoroughly discussed the board decided that the easiest and most satisfactory method of securing the money was by means of bonds.

It was decided that the amount of bonds should be 150100 bearing interest at 42 per cent. At the end of the first twenty years it was provided that mooo per year or bonds should be withdrawn so that at the end of thirty years every bond would have been retired and not one mill of extra tax have been placed upon the people. The bonds are not satisfactory to the people and they. voted them down. The Jail Will lie Built.

The county commissioners have deter. mined to build a jail and conceive It as their duty' to raise the money for that purpose. There remains but one method and that is the direct T. Every member or the board that has expressed himself is in favor of a Jail and throe out or five or them have come out squarely for a direct tax and an immediate start on the jail. With all these Indications it is safe to say that therewill be a new jail commenced before October 1st of this year.

It is possible that may be contracted for and begun earlier than this. but Chairman Collier is rather of the opinion' that it may not be done until fall. Chairman Collier or Direct Tux. The new Jail is an absolute necessity. said Chairman Collier yesterday afternoon.

The bonds have been defeated but it is no more than I expected. The bond election isso surrounded by legal points that it Is nearly Impossible to get an expression or the zeal opinion of the For instance. It requires a two-thirds majority of the Qualified yoUrs. It every mau voted in favor of the bonds and there were two votes less than a two majority cast the bonds would be lost. This is the law.

though It does appearunfairon the surface. Thegrand Juries have been condemning thaprwentJail orpeveralyears There Is no doubt in my mind but that it-is really disgrace to Fulton county or. any other county. Fulton county has. outgrown the present Jail I refer simply to size.

He has seen the necessity for a new jail and regrets tile defeat or the bonds. I am most assuredly in favor or a new jail. said Commissioner Adair. The defeat of tile bonds will mean to me that the people do not desire to build the jail with bonds. It a direct tax la the only other recourse I am In favor of the direct tax and wan tp see a new jail just as soon as possible We should have one it possible by exposition month but It that is im possible I want to see one just as soon as the arrangements can be made.

A direct tux may be the best means of building the jail after all. Comneissioner Brown has a Plan. I have not made up my mind as to the direct tax for a new jail. said Commissioner Brown. but I have a plan which I think is a good one.

The city and the county shoW combine and build a magnln. cent building for a county jail and a courthouse and city hall all in one. It would be a arngiitiic nt affair and would be in keeping with the city and county. It would stir up real estate and put II. great many people to work.

The city has not completed its bond rate and could Issue bonds right away. I think that this can be easily' carried out. Total Vote In the County. The vote by wards was published In yesterdays paper. but the country precincts were not.

The returns were made yesterday and give a total of 229 votes for each candidate in the twelve country precincts except Sheriff Bumes who received 2:3. The vote for the bonds was 20:1 and 25 against them. The vote In each county precinct was as follows Blackball. 5 all for bonds. East Point 6 all for bonds.

Battle Hill 8 all for bonds. Buckhead. 10 all for bonds. Peachtree is all for bonds. EdgewooU 16 for bonds It and 1 against hern.

Collins ii for bonds 12 and 2 against them. Adamsvllle 20 for bonds 19. Cooks 45 for bonds 43. South Bend. Mr for bonds 21 and 5 against.

The result as announced in yesterdays Constitution showed the detent of the bonds and as a consequence there were only two members of the county commissioners present At the 12 o'clock meeting yesterday to receive the votes on the bonds. County Attorney Roswrwas present as were Commissioners Adair and Brown.
