The news will have an Important bearing on the cotton situation which is the thing of most vital interest In the south at this time. The Constitution has spared no pains to pre. in detail all the news obtainable bout the cotton crop arid the weather conditions since the tlisastrous hot wave first spread over the country. The cotton roar- ld is now being governed to a large extent by the climatic conditions which have been unusually unfavorable during the past three weeks.

If relief is on the way as promised. it will not conic a whit too. non. The state commissioner of agriculture Mr. XesMtt stated yesterday that he be lieved the damage to the cotton crop from the heat and drought amounted to at least 3 per nt.

This statement was made. the commissioner after a careful in- vestgatlon of all official reports received it his office and after a. personal inspection of the growing crop in nearly all parts the state. Cotton Plant Parched Everywhere. The cause for this tale of affairs is the beat unaccompanied by rains which. has dried up the sap or the plants and left them parched and almost lifeless. Unless rotor fall throughout the extent of the rotton belt within a. few days.

Mr. sbitt asserts that the damage will be tar greater than it now is since the plant everywhere is in very bad condition and utterly unable to stand much more punish nent from the blistering heat. A conservative estimate of the crop for this year places it at a little more than 8000000 hales. The original estimate went above 10100000 bales and some prophesied that the yield would amount to 11000000. Last year Georgia produced nearly 1200000 Bales It will probably be much smaller than that this year though.

With the unfavorable crop reports go as natural consequence a higher market. As the supply diminishes the price. in crease and yesterday there was a. big Jump upward in the price of cotton. resulting from the reports of crop damage which have been received from the cotton kit.

Prices are expected to have the bottom knocked uut of them in September while they ought to be restored In October if the expected happens. The rise during the past few weeks has amounted to 7 or 10 a. bale which means a good deal when one has Invested In a few hundred. Quite a number of the speculators won on their risk. Then there are others they were on the wrong- side of the fence and got it where thejxntle got the cork.

A. S. ROBBINS DIES SUDDENLY. Spent a Pleasant Day with His Family Sunday. After an illness of three months Mr.

A. S. Robbing one or Atlanta's substantial citizens died early yesterday morning at his residence. 16 Hill street. Although it was known that he could never get welt.

and hW death was not unexpected at the same time. it came with a suddenness that shocked his family and friends. For three months he had bt en troubled with some disease of the heart and hail for the greater part of that time been curt- fined to his Sunday he seemed to be better than usual and he was up and about the house the greater part of the day and was very cheerful. being Hen more so than usual. He ate sup with his family and laughed and jolted like a welt man.

Early in the evening he rtirJ and at the time of his retirement complained or pains about his heart and stilted that he did not feel very well. Mr. Robbins slept as well as was his wont until about midnight when he awoke and asked his wire to remove the poultice placed by her earlier in the evening. He sat up in bed so that she could remove the poultice I' and when she had almost takenlt from his body he foil back in an unconscious condition. His wife thought lie had fainted but he gave it few short gasps and in a.

Judge Berry was busy yesterday trying criminals in the city criminal court who were charged with various minor offenses. Pat Waters was charged with earning weapons and with assault and battery. He was acquitted on the latter charge but was convicted or carrying a tol in his pocket and was fined r-i and costs. Hi Standiord. who was charged with carrying concealed weapons was placed' on trial and a large number of witnesses testified.

After the jury hail been out more than an hour a mistrial was declared. M. 31. Davies. charged with assault and battery.

Yesterday morning Governor Atkinson pardoned three men who were la the pen- uUary serving time for committing the of assault with intent to murder. The men pardoned were James nOIlJ Dock rIohannOn and lames IJohannon. AU- three of them were sentenced front Douglas superior court. in 1812 and all had worked out a large part of their terms. The action of the governor in granting another opportunity for an argument due to newly discovered evidence that was. submitted to him for consideration yesterday at noon. At that hour James W. Austin. who has represented iianye since tile killing or Spinks and a number of friends who are Interested in the case.

appeared before the governor and asked for a. conference. The evidence introduced yesterday was in the nature of two aditlavits bearing upon the circumstances of the tragedJ. One affidavit. and the one containing tire newly discovered evidence was signed by Watt Gantt a ngro man.

who was an eyewitness to the fatal difficulty. The other affidavit was signed by Drew Rabb. a negro used by the state as a. witness for the state at the trial. On theafternoon of thei difficulty Gantt was present in the Decatur street saloon.

He went to the bar with another negro to get sit order book signed for the delivery of a el of whisky. lie says the order. was not signed at first by Holland the barkeeper and the negro went a second time for the signature. While he was waning for Holland to sign the order the tight between llanye and Spuks occurred. Gantt says in his affidavit that he was standing within four feet of the two men and saw the fight from beginning to end.

Ht' swears positively that struck Harye a Wow in the face. knocking oft hat. The men then clinched and Sptnks tripped ilanys and they both fell to the floor. Gantt swears that Ilanye did not strike Spinks before the two clinched. lie says he did not see any blow struck by Ilanyc.

As the niPn struck the floor Stinks's hat was knocked oft' When the fighters were separated. Uantt says hi" saw Mood on the fares of both men. The nigro then left the barroom and on the next day he left Atlanta. for South Carolina where he says he lives. How the Affidavit Ws Secured.

After the affidavit was read before the governor Mr. Austin explained the manner in which the affidavit hadbeen secures and the reason it had not been presented at an earlier date. We have worked almost day and night for the it. said Mr. Austin.

On the day following the tragedy l1lI1lt left the city and went to his horn- in South Carolina where he was en route. II hail been in Atlanta only three or four Ian and falling to find work with the railroads he was compelled to leave and return home. We sent Captain Crim to South Caro. lina to get this affidavit from Janlt but the negro twins a railroad man had gone' out on the road. lie was running on another road and.

Captain rint failed find him. We have sine been endeavoring to find Gantt. but it was not until yesterday that we succeeded In addition to Gantts affidavit. WI' will introduce an affidavit from the netrro Drew RablJ stating that Gantt was in the tar. room on the afternoon and saw the light.

This affidavit also vouches for the jt od character of Gantt. You will remember. governor. said Mr. Austin.

in reading over the record in the case no one has sworn they saw Hanye give the blow. Both Holland and Dunlap witnesses for the state say they heard the slap given by Spinks but their' testimony dose not say they saw htatiye strike Spinks. We have here an affidavit from an witness. who swears Iiaiiyt did not strike Spinks and we believe this should be carefully weighed before you refuse to grant a. commutation.

Decides To Reopen the Case. Governor Atkinson stated- after the affidavits had been read. that he would hoar further argument in the ease Thursday morning He did not commit himself in the least and did not say what lie thought of the testimony. He left last night but will return Wednesday afternoon and Thursday morning a last plea will be made for Hanye. The Work Progressing.
