SlfreS Lrta riMiir yik. Ia the Board of 8a per? leers yesterday, after our Second Edition report eloeed, a motion to adjourn was lost; atao one that the election ot a Penitentiary Commissioner be made the special order for today. On motion at Mr. Carney, another Informal ballot was taken, but without any satisfactory result, and the Board adjourned until 10.30 this morning. Tbe supervisors were at loggerheads on the election of a Commissioner to tbe Penitentiary.

In caucus Tueeday a majority ot the Republicans decided upon Richard JEveas, and a majority of the Democrat thought It vaoold be tbe proper thing to retain in office Mr. Whltford Harrington. There were just enough enemies of both candidates, however, to prevent either getting the desired number of votes la tba open Board. When this was found out botk factions aad antafda nolltf- etsnt began palling wires to effect a compro' mlse. The Democrat yesterday threw Har rington overboard and tried Simuel M.

Welch, who, an Eighth Ward Harrington parti an asserted more than once, was no Jlmmycrat," and August Seheu i--n ot tbe ex-Mayor, who made no bones ot declaring that be would not accept the office -no, not for a thousand dollars. Ia spite of great deal of persistent button-holing both young men fell short ia tbe open canvass. Mr. Evans's friends stood by him loyally until the close of the session, when Mr. Alfred Lytb began to develop unexpected strength at to expense ot the Thirteenth Ward candidate.

Tbe following table will show at a glance tbe varying support reosived by the candidates up to the adjonrnmsntlaU i a a 1 1,1 I tat is 5 First Second Third Fourth Fifth Sixth Seventh Eignth Ninth Tenth Kleventb 24 1 2 24 It 23 14 i Tbls morning the wrangling was resumed In the City and County Hall corridors, and until alter eleven o'clock tbere was no prospect of a meeting. Tbe Republicans went into osncus and harmony was restored by an agreement to vote solidly for Mr. Lytb. Tbe Democrats were all at sea, tbe cause at usual, being too many aspirants for recognition. They could cot get locelber end talk the matter ovor -quietly like sensible men, and finally several left tbe building In d'-sgust.

At 11.27 tbe Republicans, 20 entered tbe session-room, determined to organize sod proceed witu the baainess in nanu. -t ueir action caused a stir in tbe demoralized Demo crallccamp, and messengers were sent sfter the absent brethren with all speed. In tbe meantime the Clerk bad called the roll, and announced quorum. Mr. Murphy moved to take an informal ballot for Commissioner ol the Penitentiary.

It was carried, and Messrs. Stelngoetter and bmltber were appointed tellers. Tbe balloting was progressing as quickly as possible, when the Democrats began straggling Into the- chamber. No notice was tsken 'of them, snd the tellers announced the result of the ballot as follows: Whole number of votes cast 26, of which Alfred Lytb received 24, and August Scheu 1. Mr.

Kendsll who was paired with Mr. Taber, did not vote. The first Democrat on his feet to proles sgslnst wbst be called "a map game," was Mr. Nichols, who attacked Messrs. Kendsll and Wood, (tbe 'latter, It was claimed, was pslred with Mr.

Wealberbee)' lor bresking their pledges not to set on the question Of Penltentisry Commissioner. Mr. Torrance followed up the sstsuit and entered a protest more empbatio tbsn his colleague, sgslnst what hs considered unfair ard dishonorable action on the part of the majority. Several other Democrats protested. Mr.

Wood explained that be paired with Mr. Weatberbee on tbe question before tbe house for one session only, snd he did not be lieve be hsd broken fslth in being present snd voting today. Mr. Kendall also arose snd took the ground that a paired member ot a legislative body must not necessarily sbssnt himself from tbe regular sesidous, hence bis presence. He bed not voted and therefore failed to tee wherein he hsd violated his word ot honor with Mr.

Taber. There being a goo4 prospect of an Interminable snd unplexssnt debate Mr. Foster took tbe floor snd in a conciliatory speech, moved to rescind the previous action and proceed to a formal ballot. Messrs. Smtther and Kendall endorsed the views of tbe pesce-msker from Marills and said tbey would vote for a reconsideration rslher tbsn bsve any reflections on tbe Bjsrd.

Mr. Nichols said that there were no two members of the Board he bad more respect tor than Messrs. Wood' and Kendsll, but be did no. hesitate to assert that they had made a mistake. Chairman Young said tbere was no doubt in his mind a to tho right of a' paired member to attend tbe dally sessions.

The motion of Mr. Foster was then carried. Mr. Smlther insisted 'on Mr. Wood's vote being recorded.

Tbe latter soon after retired to the lobby and remained. Why be did so, under the circumstances, was not plain. Subsequently Mr. Taber arrived and after consultation with Mr. Kendsll their pair was broken.

Before the ballot, taken la accordance with Mr. Foster's resolution, could be announced, the Democrats begun filllbustering and kept it up vigorously. On counting the vote it was found that they were In excess ot the number ot members present, and another ballot was ordered by tho Chairman. A motion to adjourn till tomorrow was made by Mr. Torrance and an amendment was offered by Mr.

Spencer that it be till Monday. Mr. Murphy, however, made a further amendment that Board proceed by a viva voce vote to the election of a Penitentiary Commissioner. Tbe tllllbuiters were now more lively than ever and the Chairman was obliged to rap loudly and repeatedly to preserve order. Th amendment of Mr.

Murphy we finally carried, and be tlen mived that Mr. Lytb be appointed Commissioner. Mr. SIrrel substituted the name of Richard Evans, and Mr. Torrance the name ot Angutt'Scbeo.

Motion to adjourn and take a recess wera lost and ruled out ot order, and the es and were called on- every question, thereby delay lag final action a long as possible. Mr. Scheu received 21 ay es and Mr. vans 7. The Clerk announced the vote on Mr.

Lytb as follows: Ayes aleasrs. Briggs, Brown, Butman, Corn well, DeGrair, Forsyth, Foster, Bogan, Jenkins, Kendall, Leighton, Moest, Meemer, Murphy, Reister, Spencer, stlekney, Scbier, Stoneway, Steingoetter, Bntither, Sirret, Torrance, Wohlers, Wiltse, roaog26. Nava Messrs. K. 8.

Mr. Nichols raised the- point that an election was not legal except by billot, but It was not entertained. Murphy moved, that the vote on Mr. Lytb be reconsidered. Lost ayes 20, nay 26' Brevities.

Tbey oon reported tbe follow- MEMORIAL. In view of tbe death of Patrick gmlth, it is fitting mat bis late associates In this Board should give expression to their sorrow at the loes ot their departed friend and colleague. Smith waa among tbe earliest friends and promoter of the Park eeheme. and erer since be became a member of the Board, bow neaxty ten years aa-t. toad taken a lively interest In the management of Its affairs.

He bad been a moat regular attendant at oar meetings, and by wise counsel, aoond judgment and correct taete contributed much to tbe deeiston ol every eneetion before the Board. He took great pains to be well informed in regard to tbe nature and merits ot every improvement made on tbe grounds, and was always constant and Indefatigable in bis efforts to nrtber tbeprogress ot tbe work, and to insure iu succeed, we mourn sad shall mlas him, not merely as a trusted associate, but as an honored friend, leading an exemplary life, who won car wirmw regard by bis genial disposition, hopeful temperament, high integrity and Christian character. Be waa as honest man, the noblest work of RtfAvtrd, That this memorial be entered upon tbe minutes of the Board, and that a copy of the time, together wite the assurance at oar sincere sy mpstby and condolence, be sent to tbe family ot our departed colleague. Mr. Jewett took occasion to say, with a voice that was tremulous with emotion, that he bad known Mr.

Smith In all the trials and temptations of life, and never knew him to swerve from the right in a single Instance-He bad been one of Buffalo's most exemplary citizens and bis memory would be revered by all who hsd known ot bis honored and honorable career. Mr. Holmee was also deeply affected and found it difficult to muter bis feelings suffi ciency to express his sense of appreciation, of tbe life and character of the deceased. In speaking of tbe deptrted, be esld, are often constrained to east the mantle of charity over the defect of character. Sometimes in tbe words of the eulogist it is difficult to recognize our friends a we knew them.

There is no need, in this instance, for anything of that kind for Mr. Smith was a noble open-hearted, Christina man. Each bour and day found blot the am man (very hour of his lite seemed to be one of sunshine for bis friend. Hs was earnest and conscientious In the discharge of bis duiles, and delighted In doing deed of kindness. Mr.

Nellsny had known Mr. Smith from his boyhood. He was a good man In avery eense of the word, whose life was a beacon light to those who were around bim, and wbo had-left an example wbich was worthy of emulation. He wss very devoted to bi native country although a Hue American. Mr.

Clarkson N. Pot ter, Gov, Phelps of Vermont Cortlandt Parker of N. sat upon tbe bench. Oalteau said: Your Honor, It will be a great misfortune if snytblng should happen to this jury, they are very honest, Intelligent men, and I want the best care taken ot them There are some of tbem unaocustomed to Sood, wholesome food, and consequently they ave indieestion. I want the Court to order them out every morning for a walk of four or five miles before breakfast.

I hsve two or three more little speeches to make, but this win do for toe present. Judge Cox, The Court will attend to the wants oi tne Collier recalled. Witness never detected any slsrns of Insanity in the prisoner. Scoville began to cross-exsmine witness, when Uulteau, la a great rase, shouted never saw this man but once In my life, and that was in 1878. I never saw him five min utes in my life.

What does he know about mer This shows just how little sense yon have got, Corkhill, to put ui this msn as an expert. (To Scoville). And you haven't got common borse-sense, to waste the time of the court in examining a man of his character. He was only a clerk in a lawyer's oiUce any wav." He-examined by Corkhill Witness. In mv opinion, at the time I knew bim prisoner was perfectly competent to otsuneuim between right and wrong.

(Exception noted by Seo- viiie.i Scoville asked: What Is your opinion of the prisoner's ability to distinguish between right ana wrong at tne present time The question was ruled out. Another ex ception wss noted by bcovllle. J. M. Justice, lawyer, of Locsnsoort.

Ind met tbe prisoner in 1878. Prisoner was selling a little book, tbe Life of Moody. Guitetn Interrupted: "You are mixing me up witn some one etse, sir." Witness continued, but sgsin Gultean shouted: Stop right here. Csn you identify me as me man -Witness. I think I can.

Guiteau Can you swear to ltf Witness. Yes, I can. Uulteau. Well, you are a lisr, sir, a miser able liar that's the wsy to dispose of you sir. Witness ssid tbo prisoner remained at Le- eansport about three weeks sailing the book, Gultesu contlnuallyintorjected abusive conv ment and finally shouted: You miserable wheip, to come in here and mske me out a book agent.

I was preaching the Gospel snd I sold my own production. In a few minutes be turned to Scovlll with sn air of intense disgust, and said: Oh cut this fool short he's lying all through; don' waste time on him. Scoville asked Whs was the appen-ance of the prisoner when yon knew him A. He looked about the eame as he does now, except about the eye. Scoville.

What was the difference Jn the e-rarAaalnn nf his svsa A. At thst time be had free expression now the expression seems suppressed. uuitesu. i aon'i tninK i am much sup- pressea mis morning, sir. it seems to me I'm pretty lively this moraine.

Guiteau gradually worked himself up into a towering rage, and declaimed against tbe witness, tne prosecution, and cranks whom be claimed had threatened him with violence, nis ueing more especially directed against the prosecuting attorney. Refet ring to Corkhill, be said: He's getting too airij ana too simaing to live, ana tne nrst thing be knows God Almighty will take him on and send him Down below. Rev. Bosh Shlppen, pastor of Alt-Saints Churcn, wasblngton, boarded in the seme house and occupied a seat at the same table with prisoner, from April last until the dsy before tbe murder of tbe President, when tbe prisoner disappeared from the bouse. Wit ness had frequent conversations with prison er.

Both hsd lived in Cblcsgo, and that formed the basts of conversstlons which led to quite a familiar acquaintanceship. Prls oner was cnatty, pouie, and a little quick or nervous tn his uttaranoee, but not sufficiently so to indicate marked peculiarity. Witness never detected aaytmng to indicate insanity, and never entertained the (lightest suspicion oi it in connection wun tne prisoner. A striking feslnr of Shippen' testimony waa the statement thst the ususl topics of conversation Detween nimsen ana tne prisoner at table, where they met three time day, wore tbe Cookllng-Garfield embrogllo ana tne new testament revision, and on no occasion did tn prisoner exhibit more excre ment than sny other person mlgbt do. The former being the subject which, st Gultesu allege, impelled bim opon the President.

Sblppena testimony ts considered of tha high est vaiue to tne prosecution. Mrs. lramire. formerly wife ef Uultean. then took the stand.

She married the prisoner ta July, 1869. Scoville objected to the testimony, unless the record-proof of divoree waa shown. Witness was then withdraw, Corkhill remark ing that be would introduce witnees lster, after he obtained necessary copy of tha court recora. Doctor Nobl Young, phvslclsn at the tail waere uuiteaa ns oeea eononed, related several conversations he hsd with tbe pris oner. Witness thought thie waa decided wayer log on lbs part of tba prisoner.

Witness was asked It he considered the prisoner ssne, snd replied "a perfectly sane man, sir, and as bright, quick and Intelligent a man as von would see in a Bummer's dsy, not the slight est indication of insanity about him. A lit tle impatient of restraint at times, a llttie nervous, as men ia hi position would natural- ly be, put peneeuy sane." FROM WASHINGTON ABOUT THE A8SaniI' TB1AL Nbw Tork, Deo. 16. It is understood the prosecu tion's Hat of wltneeee a to Gultean's life and ebaraeter, alleged hereditary taint ot Insanity, Ac, is nearly exhausted.

The prosecution preserves silence aa to whether Gultean's former wife will be put oa the stand, but It ia understood she will be called.
