Arnow found that at the time of the 1947 deed of the property to the state a twolane highway with a 120-foot easement existed and the state is entitled to that easement, but he also found: the state of Florida widened the highway from two to four lanes, and pre-empted an additional 40- -wide strip for that purpose. The highway has been and is now a high speed highway; the widening effected to provide a traffic artery to serve areas outside this land, made no portion of the land available to the public for use as a park which already was not through use the previously twolane highway." Arnow said the state be given one year in which to either vacate the same, or acquire the right legally SO to use the same, by condemnation, agreement with the United States or other appropriate means." It's correct on the facts and on the Stafford said he is "glad it's settled once and for all. Should the other side appeal, I am confident Judge Arnow Decision could change history of the Live Oak property. The land was sold to David B. Rutherford, who subdivided it and sold it to forebears of the present claimants in 1880.

The State of Florida, in 1833, apparently had retained some to the land and made a deed of cession in which exclusive use of Live Oak was given to the federal government. The Secretary of the Navy permitted Boy Scout and Girl Scout camps to be built on the property. In 1946 the land was put up for sale as surplus. Three bids were received: a $100,000 priority bid from the state, a $100,000 non-priority bid from the state and a $110,000 bid from attorney F. M.

Blount, representing private claimants. The U.S. sold the land to the state with the condition that the property was to be used exclusively for "public park The deed contained a clause which provided the land would revert to the U.S if the public park provision was violated. The State of Florida went into court in an effort to obtain clear title to the land. The Circuit Court in Escambia County ruled in favor of the state but the Florida Supreme Court held the state must compensate private claimants to the land, for their interests.

In 1949 an attempt was made to get the Florida Legislature to sell the land to the private claimants for $100,000. Following more court action a special master was appoint- will be He said the decision enables the Park Service to "preserve that nearly 1,400 acres for the citizens of this area and for the rest of the United States to preserve those magnificent trees and the beaches and have a really first class recreational area consistent with the environment." "This is really what it was all about to get that area back so the federal government could develop it truly for a public In Arnow's decision he said: "In short summary, it appears by clear, convincing and satisfactory evidence the land has not, since the conveyance in 1947 and during the times pertinent to this decision, been used exclusively for public park purposes; to large extent it has not been used at all and the uses made of it cannot be characterized as uses for public park purposes." (AP) Auditor Ernest Ellison today numerous Gieneral foul ups in the state's drivers licensing system -including a computer that chews up some drivers' licenses while issuing fraudulent ones to others.

Ellison said that most of the problems came when the state two years ago went to central issuance of all driver's licenses through use of a computer in Tallahassee. "Numerous problems have been encountered in administering this program," the auditor general. He said improper record keeping was the main problem. Ellison said "a substantial number of licenses" had to be manually issued because they were "mutilated by its computer during printing." He said examples, were found where those entitled to a license had not got one while those not entitled to one had. He said at least one driver was known to have valid licenses from both Florida and Georgia.

claim to the property. On April 6, 1955 the court entered a final decree which in effect handed the property over to the private claimants but retaining the federal government's reverter clause. The litigation decided today came following creation of the Gulf Islands National Seashore. Filed last Winter, the suit decided today could be the last chapter in the history of Live Oak's legal battles.
