8, 1956 LEGAL NOTICES ORDINANCE N'O. 273 AN ORDINANCE ESTABLISHING RATES AND CHARGES AND EULES AND REGULATIONS FOR THE AND SERVICE OF THE WATERWORKS PROPERTIES OF THE VILLAGE OF WORDEN. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WORDEN, ILLINOIS: MADISON COUNTY, Section 1. That the following rates are hereby establisi the use and service of the waterworks properties of the Village of Worden: A. Meter Rates.

All water shall metered rates as lol- LEGAL NOTICES be sold on lows: Class A. Rates shall apply to all users on property in the Village of Worden subject to taxation in the Village of Worden as follows: Minimum rate per month $4.25 for 2000 gallons or less. Next 8000 gallons per month at 90c per 1000 gallons. Next 20000 gallons per month at 75c per 1000 gallons. All over 30000 gallons per month at 50c per 1000 gallons.

Class B. Rates shall apply to all users on property outside of the Village or Worden, which property is not subject to taxation for repayment of General Obligation Bonds to defray part of the cost of said Waterworks System. Class B. Rates shall be computed on metered consumption at the a charges as Class A. Rates, plus Ten Per Cent In addition to the foregoing rates there shall be charged to the Village of Worden, Madison County, Illinois, the sum of $1,000.00 per year for fire hydrant rental.

The minimum rate is applied to allj6()nnections open for service for any month. Fractional months on applicator, or termination of service may be pro-rated. The Village shall not be liable, nor shall any claim be made against it by reason of the location of its said service lines, meter boxes, tiles or valves on the premises of user until after said Water Department has been requested in writing by the owner to remove the same duly delivered to the office of the Water Department during the regular business hours and the Village shall not be liable by reason of the breaking of any pipe upon user's premises or for any interruption or disconnection of the supply of water.

D. No person shall take or use water from the waterworks prop erties of the Village except through the service pipes and meters furnished by the Department, and no person shall connect, disconnect, open or close any service pipe valve or otherwise tamper with the meter, meter cover or box or any service connection. E. No extensions shall be made to the mains by any private person, except-upon application to the Water Department and upon such terms and conditions and minimum standards oi specifications therefor as may be designated in each case by the Board of Trustees of the Village of Worden. F.

Water service is for use on the--designated premises only anc not for re-sale. No private extensions shall be made to other premises or for use of other persons. G. The Village reserves the right to suspend or limit the use of water for fountain, lawn sprinkling garden or other use when public convenience so requires. Section 3.

Bills for service shall be due on or before the 15th day of each month. A penalty of ten per cen shall be charged on all bills no paid when due. For the non pay ment of bills when rendered, or the violation of any of the terms or conditions of which service is given, the Water Department re than one family or separate dwell- serve tne right ou notice to ing unit or separate business shall shut off water serv ice until the -bil be connected to a single meter. In event more than one family, separate dwelling unit or business is connected with the same meter, with or without the consent of the Village Water Department, the minimum rate shall be multiplied by the number of such family dwelling units or businesses taking water through the same meter. The multiple rate shall not apply to rooming houses and light housekeeping apartments.

Questions of classification shall be determined by resolution of the Board of Trustees of the Village. B. Connection Charges. All persons desiring water service shall make written application therefor to the Water Department stating the owner of the premises, the occupant of the premises, the street acic'ress or lot number where service is requested and the mailing is for billing purposes. In addition to the privilege to disconnect service, the Water Department may enforce collection from any deposit or other money on hand belonging to said consumer, or in any other manner provided by law. Section 4. Pending the reading of meters for any reason, bills shall be estimated on the basis of the previous bills for service to said premises and any deficiency or surplus shal be credited or charged on the nexl bill following a reading of such meter. Section 5 The Village of Worden reserves the right to make such changes in the rates or charges and rules and regulations i established which may be found expedient from time to time, and the same effective and binding upon connection charge shall be none. After service lines are once connected there shall bo no connection charge or shut off charge for the old customer or the' new customer at the same premises. In event service is desired to premises not abutting upon an existing main, the applicant shall pay the additional cost of the extension of service from the edge of the street opposite the nearest main. A charge of S5.00 shall be mac'e for shut off and turn on made at the request of the consum-: er for his own convenience.

All persons making application for service shall establish credit by: 1. Proof of ownership by applicant ot premises serviced, or 2. If applicant is not the owner cf premises, a written guarantee by the owner of said premises for the faithful payment of all service charges, or 3. A deposit with the Water District of a sum equal to the estimated service charge for said premises for two months. D.

Meter Testing Charges. AH persons desiring water meters tested shall pay in advance $5.00, which sum shsll be refunded if the is found, to be faulty. E. Contract Rates. The Village Board of Trustees may, by resolution make special contracts for limited time ior construction contractors or other persons desiring to take substantial quantities of water for special purposes or may make special contracts with other municipalities, districts, or corporations for the supply of water on wholesale basis or for fire protection purposes, and for hauling by tank truck lot.

F. No persons or organization shall be given any free service and all unauthorized connections shall be prosecuted to the fullest extent of the law. Section 2. All persons receiving water from the waterworks properties of the Village of Worden shall accept the same subject to all of the provisions and conditions of this ordinance On violation of any of the following conditions, water service mav be shut off without notice, and the" Village may enforce all other legal remedies.
