Seconded by Mr Spalding. Mr Kaiser objected, saying the Board had a rule to deposit a check when bidding and these bidders did not do that. Mr Kimberlin made motion to suspend the rules and take action on the matter. Seconded by Mr Spalding. The Chairman declared the motion suspend the rules out of order.

Mr Gilbert i i then submitted i i report, recommending the contract for radio lower be awarded to Messrs Field Field, of Collinsvillc, their bid being the lowest submitted by Madison County linn and being $111.00 below the 53476.00 bid of Dron Electrical Company of Granite City. Mr Killinger moved adoption of minority report, seconded by Mr Spnld- Mr Kniscr moved that all bids be that is no money to pay for same but $80.00 as the moil- ay did not come in as promised nnd there is no way to pay for the tower, all bids to be rejected at this time until money is donated or appropriat- Seconded by Mr Dumont. Mr Kaiser explained the tower was needed but the Board could not contract for it i money is appropriated or donated.

He said it was thought the steel went to the i floor of. the Court House and on investigating it was found necessary to come to the roof of the second tloor i an eye beam costing about $2200 and the money promised as a donation was not remitted. He said the committee had no idea the tower would cost so much. Tiie following report was then submilted: We, your Road and Bridge Committee, beg leave to report that Motor Fuel Tax claims, and 15-D Refund Claims, as listed below, for the month of January, 1938, have been audited and signed and your Committee recommends that the County Clerk be directed to issue vouchers to the several claimants as shown by properly signed claims: A 33 (US 40) Section Wade 122.20 Wade 38.08 County Board of Supervisors, hereinafter "The that ermission and authority be and is icreby granted to. the Company, its iuccessors and for a term of wenty-five (25) the date hereof, to construct, operate and main- a telephone line with the necessary poles, wires, cables, fix- ures and appurtenances over, along, under and across a portion of State Aid Route 19, at a location described as follows: On the east side of State Aid Route .9, beginning at a point approximately 3-8 mile north of the southwest corner of Section 18 in Edwardsville Township, and running thence north mile. The above is subject to the following Conditions: First. That the Company shall construct said telephone line so as to not unnecessarily interfere with the public use of said highway. Second.

That the Company shall place all poles and anchors at least three (3) ieet back -of the, present ditch lines of said highway, and in crossing said highway the wires and cables shall in no case be less than Twenty (20) feet above the surface of the road. Third. That the said Company shall safe-guard the County of Madison against accidents or loss of life, during the construction, operation or maintenance of this line, shall save the County of Madison harmless, during the life of this Permit, against any damages direct or indirect, that may be suffered or claimed on account of such construction, operation or maintenance of said telephone line, Fourth. That the Company at any time, upon written request of the County Superintendent of Highways, will set back or move any of its poles or anchors within the limits of the said highway, when such i becomes necessary in the construction or improvement of said road, Fifth. That this Permit, is issued contingent upon the Company paying to the County the sum of Five ($5.00) Dollars, as compensation to the County for the use of such highway, sale money to be payable to the Treasurer of: Madison County and upon receipt of same to be deposited in the County Highway Fund of said County.

Permit is not effective until the provisions contained herein are acceptec by the Company. The County Clerk of Madison County is hereby instructed and authorized, upon receipt of the payment herein referred to, to sign this Permit in duplicate in behalf of the County of Madison. Sixth, That this Permit is issuec nly in so far as the County has jur- sdiction and does not presume to re- ease the Company from i i any xisting Statutes relating to the con truction, operation or maintenance if such telephone lines or the rights under the law of the owners of abut ing property along said highway. Passed by the Madison Count; hereby authorized to send statement if. such cost to S.

F. District Engineer, East St. Louis, Illinois, with equest for payment from aforesaid uel tax allotment. Be it further resolved, that this esolution be submitted to the Department of Public Works and Buildings, State of Illinois, to guarantee payment of all cost for right of way needed on said Section 55-MFT, State Lid Route 5, (also known as State Bond Issue Route the detailed ocation being described as follows: Beginning at a point near the corner of the quarter of Section 5-5-9 and running thence northeaster- to a point near the center of the southwest quarter of Section 14-6-9 said point being in the Village of Fos- Mr Knoche moves seconded by Mr McDow that foregoing resolution adopted. The ayes and nays being called for resulted in a vote as follows: Ayes--Messrs Carr, Davis, Dumont, Sllis, Farrell, Girard, Gnoth, Grenzer, Gruenfelder, Gvillo, Hagnauer, Henke, Johanntosettel, Johler, Jones, Kaiser, Kettler, Kimberlin, Kimack, Board of Supervisors, this bids, not having in- the Board, nnd the lutions out of order.

Mr. Meadows then explained his had position, saying the committee been misled as to the cost, all equipment save the tower being installed nnd not paid for and the Sheriff's office desiring at least a 30 days trial before paying, and the committee had proceeded i a i of the Board. Mr Girard moved that the Auditor have power to call for bids for anything over 5200. The Chairman stated this appeared In the rules. Mr Wickcnhauser stated since there a controversy, he moves we forget about buying this i it's done in a legal way by advertising for bids.

Seconded by Mr Carr. The Chairman staled that according to the rules, the whole thing is out of order and accordingly ruled all the resolutions out of order. Mr Killinger appealed from the decision of the Chair. The Chairman stated it takes 2-3 vote, and asked the Clerk to call the roll on appeal from the decision of the Chair, stating nay vote meant to grant appeal, aye was to sustain the chnir's decision, resulting In vote ns follows: Ayes--Messrs Carr, Dumont, Ellis, Cirnrd, Gnoth, Gvillo, Hngnauer, Hen- Johler that foregoing report be adopted. Motion carried.

The following wns then submitted: We, your Court House and County Jail County Home Committees, recommend that the County Auditor be authorized to advertise for bids for clothing and shoes for County Home nnd Jail, groceries' for County Home and Jail, meat for County Home and Jail, bakery goods for County Jail, laundry for Court House, flour and cornmeal for County Home, for a period of six months, beginning April 1, 1938. The following was then submitted: We, your Right of Way Committee to whom was referred the application of the Illinois Bell Telephone Company to construct, operate and maintain telephone line over, along, under and across a certain highway known as State Aid Route 19 in Madison County, beg leave to report that we have considered the application and recommend the adoption of the accompanying resolution: CHAS I-I KNOCHE LESTER MAY WALKER HERBERT GVILLO Permit: Madison County Board of Supervisors to Illinois Bell Company: Whereas, the Illinois Bell Telephone Company, a corporation organized anc existing under the laws of the State of Illinois, hereinafter termed "The Company" has requested permission and authority to construct, operate and maintain a telephone line with the necessary poles, conduits, wires cables, fixtures and appurtenances over, along, under and across a certain highway of Madison County known as State Aid Route 19, Now therefore be it resolved, by Snoche, May, Prehn, Reedy, McDow, Romann, Meadows, Rousseau, Steiner, Suppiger, lauscr and Wood.

Nays--None. Ayes--37. Nays--0. Whereupon the Chairman declared Uie foregoing resolution duly adopted. The following was then submitted: We, your Right of Way Committee, to whom was referred the report of the Superintendent of Highways relative to right of way for Section 55-M State Aid Route 5 (known as the Fosterburg Road), wish to report that we have examined the Dedications and plats now on file at the of- lice of the Superintendent of Highways, and your Committee recommends that the same be secured at once.

Your Right of Way Committee therefore requests that said Committee and the County Superintendent of Highways be, through the adoption of this report, authorized to secure by agreement, purchase or condemnation, the right of way needed for the proposed improvement, all such agreements as made by said Committee to be reported to and approved by this board prior to payment. Motion carried, The following resolution was then submitted: Right of Way Resolution: Be it resolved by the Board of Supervisors of Madison County at its meeting this 10th day of February, 1938 that there is hereby appropriated the sum of Five Thousand dollars, or so much thereof as may be necessary, from the said county's motor fuel tax allotment, for the purchase of Right of Way, together with all court costs, and jury awards in necessary condemnation proceedings, required for Section 55-MFT, State Aid Route 5 (also known as State Bond Issue Route ----). When detailed cost for each tract, or condemnation are known, the County Superintendent of Highways is Schmoeller, Schneider, Smith, Spald- ng, Stahlhut, Steiner, Suppiger, Walker, Wickenhauser and Wood.

Nays--None. Ayes--38. Nays--0. Whereupon the Chairman declared the foregoing resolution duly adopted. The following was then submitted: Right of Way Resolution: Be it resolved by the Board of Supervisors of Madison County at its meeting this 10th day of February, 1938 that there is hereby appropriated the sum of Five Hunderd Dollars, or so much thereof, as may be necessary, from the said county's motor fuel tax allotment, for the purchase oC Right of Way, together with all court costs, and jury awards in necessary condemnation proceedings, required for Section 63-MFT, State Aid Route 9-B Ext.

(also known as State Bond Issue Route When detailed cost for each tract, or condemnation are known, the County Superintendent of Highways is hereby authorized to send statement of such cost to S. F. Wilson, District Engineer East St. Louis, Illinois, with request for payment from aforesaic motor fuel tax allotment. Be it further resolved, that this resolution be submitted to the Department of Public Works and Buildings, State of Illinois, to guarantee payment of all cost for right of way needed on said Section 63-MFT, State Aid Route 9-B the detailed location being described as follows: Beginning at a point near the Southwest corner of Section 33, 4 8 of the 3rd at the intersection of A Route 9-B and I Route 157 and extending in a northeasterly direction a distance of 5,625.0 feet.

We, your Right of Way Committee, beg leave to report that agreements have been reached with the following parties on State Aid Route 9-B Extension, Section 63-MFT, also known as the Peters-Glen Carbon Road. Edward Meier, .07 acres $375.00 Your Committee recommends that the Superintendent of Highways be directed to make request to the Department of Public Works and Buildings, for sufficient Motor Fuel Tax monies, heretofore appropriated by this Board to pay said amounts, and that the County Clerk be and is hereby directed, upon the County Treasurer's receipt of said funds, to issue vouchers to the several owners, on the amounts shown and to delive'r said vouchers upon receipt of properly signed dedications. Frank Pike, 2.12 acres 750.00 Lulu Voelker, 1.68 acres 3,349.00 Wade, money advanced on options 15.00 Your Committee ercommends that the Superintendent of Highways be directed to make request to the Department of Public Works and Build- Motor Fuel Tax appropriated by construction of said State Aid Route 33, that the Department of Public Works and Buildings be and is here- 3y requested to institute and prosecute condemnation proceedings, for the purpose of acquiring right of way for road purposes over, along and upon the following tracts of land, all situated in the County of Madison, State of Illinois, over, along and upon which said State Aid Route 33 has been surveyed and located, to-wit: A tract of land containing approximately 2.41 acres in the southeast quarter of the southwest quarter of section 7-3-6, owned or claimed to be owned by the Frank B. Kuhn estate. Also a tract of land containing approximately 0.55 of an acre, in the southeast quarter of the southwest quarter of Section 12-3-7, owned or claimed to be owned by George W.

Meyer- Trustee; Be it further resolved, that all County Officers prepare for and cause said right of way to be acquired and that all court costs, judgment of jury and attorney fees be paid by the County of' Madison, And that the State of Illinois be hereby advised that all such costs will be assumed and paid by the County of Madison. Be it further resolved, that the County Clerk at once transmit a copy of this resolution to the State of Illinois, Department of Public Works and Buildings, Division of Highways, at Springfield, Illinois. Mr Knoche stated in reference to communication from the Granite City Commercial Cktb that the Right of Way Committee had looked at the property needed for approach to the Venice viaduct and felt like condemnation proceedings would be the only- way to secure the property.

There was then a lengthy discussion of the matter of procuring needed right of way for approach to the viaduct. The following report was then submitted Your County Auditor begs leave to report that he has examined and audited the following claims presented, and recommends payment, and that the Clerk be directed to issue orders to the several claimants, to-wit: State Institutions (Fund 420) Catholic Children's Home 160.00 Mrs Ann Wind, 1631 Third St, Madion. Mrs Bessie Turner, 2542 24th St, Granite City. Mrs May Collins, RR No 2, Godfrey. The following applications were rejected on account of not being blind or industrially blind: Mrs Corda Dodd, 632 Bowman, East Alton.

The following was then submitted: Mr. Chairman and members of the Board of Supervisors: It has been called to my attention that many tavern owners in Madison County are not observing the opening and closing hours adopted by the County Board.

I would recommend that the County Board instruct the Sheriff's office to compel all tavern owners to abide by rules adopted by this board. All of which is respectfully submitted, Arthur Rousseau. Mr. Rousseau moves adoption of recommendation and asked for roll call. Seconded by Mr Carr.

The ayes and nays being called for resulted in a vote as follows: Ayes--Messrs Carr, Ellis, Girard, Gruenfelder, Gvillo, Hill, Johler, Kelt- ler, Knoche, Rousseau, Smith. Steiner, Suppiger, Walker and Wood. Nays--Messrs Davis, Grenzer, Hagnauer, Henke, Jones. Kimberlin, Kimack, Reedy, Romann, Schrnoeiler, Schneider, s'palding and Stahlhut. Mr Meadows answered not, voting.

26, stating that "No expenditure of any amount exceeding two hundred ($200.00) dollars shall be authorized without having lirst been submitted to the board for its I recommend that all committees, fay way of resolution, authorize bids to be advertised for in local newspapers and that the County Auditor be given this authority. All of which is respectfully submitted, Frank Girard. Mr. Rousseau moves seconded bv ings, for sufficient monies, heretofore this Board to pay said amounts, and that the County Clerk be and is hereby directed, upon the County Treasurer's receipt of said funds, to issue vouchers to the several owners, on the amounts shown nnd to deliver said vouchers upon receipt of properly signed dedications. Whereas, this Board, at its meeting of December 14th, 1937 authorized and directed the Right of Way Committee to acquire by agreement or condemnation the necessary rights of way required for the construction of State Aid Route 33, also known as Route 40, and, Whereas, your Right of Way Committee is unable to reach agreements with certain land owners along said route, from which it is necessary to obtain right of way, and, Whereas, the State of Illinois has agreed to construct said road as a part of its Federal Aid Program, Therefore be it resolved, by the Madison County Board of Supervisors that in order to co-operate with the State of Illinois and to expedite the ilr. Girard that the foregoing recommendation be adopted. Motion carried by acclamation. Mr Aug Hoelscher, representing the East Side Manufacturer's Association then spoke to the Board members in the interest of seeming right of way for Venice viaduct approacn and urged early action. Mr Ussery also spoke along the same lines.
