It was expected the ease cf Mrs. Lif-lie Davis, who hod John Hall arrested for assaulting her with divers deadly weapons, and Anally winding up with choking her, would develop some startling features of ferocity on the part of Hall, the recital of which would curdle the blood of the listeners.

Yesterday the case was called, and a Mia. Davis took the stand A 8II.KNCB At OF DEATH fell upon the expectant throng. The attorney for the prosecution squared himself and told her to tell the story. Judge of his surprise and everybody else's when she had nothing to say, and it was with the utmost difficulty she could be prevailed upon to admit that he choked her just a little, while it was evident if she could have gone behind tli record she would not even have admitted that. The parting scene was told amid tears that moved tlio whole audience.

Judge Clark hail to use bia handkerchief freely trying to make believe ho had a bad cold, but the suspicious moisture in his eye told that it was the weeping woman's story that melted the eye-juice out of him. It was the morning anVr the row. She started for the door, and Johnnie PUT HIS AKMH AKOU.fD HKR and kissed her and asked her if she would be his? There the prosecuting lawyer wept bitterly. What did you say to this was finally asked rVb-SniMe "I-sob-said-sob-y-e-s." The audience wept with her. John was called after Hank Bcanian bad mopped up the floor.

He gave one look at Bessie and burst into tears. She looked towards him and responsivcly followed suit. It would be doing our readers an injustice to barrow lip. their feelings by further description of Tills st T.N B. Sufficient to say that the attorneys on both Bides were wholly unable to speak.

And Judge Clark at last exclaimed: "This is too much it is too much I dismiss llic case;" but recovering: himself, be added; "Mr. Hall, you will have to pay the costs." As she was leavinir the room John held out bis arms and murmercd: "Bessie." She turned ami in a moment more would have been locked in bis embrace, but her lawyer quietly but firmly restrained her, and led her we eping from the room. Alsiut thii time one of the iKjstofiice clerks came rushing into the room, wanting to know who in thunder had spilled a barrel of water, and swearing it had wet everything down stairs; but on learning the facts in tbc case, he silently departed. Judge Clark declared that, in all his nutgister-ial exMrience, be never had anything strain him like that did. 4,000 ZPOTTHSTDS -AT THK Big Horn Store MATIESSEN GOLDBERG, K.

Our space is, however, fully occupied by the result of the diligent and arduous labors of Judges Clagett and Murphy, the sub-committee appointed to revise the United States mining laws and suggest amendments to them. The appointment was made in compliance with a request of the public land commissioner, and no better selections could have been made.

Judge Clagett has assisted in the framing of every mining law, with two exceptions, ever drawn up in the western territories from here to the Pacific coast. The report of this committee is a long one, but it will be of interest, not only in the Black Hills, but in all the mining regions of the continent. Personal. A Coed Rule. Justice Column has determined upon a new plan of procedure that will meet with the hearty approval of every man in the city.

In the future, when a man comes in with a frivilous complaint, he will lie compelled to pay the costs or go to jail if he fails to make out bis case. He was induced to make this rule on account of several foolish caes rwing brought before him; the last one that of Buffalo Bill, who swore out a warrant a-zainst Paul King for assaulting Jennie Hi mn. Paul warrested and taken fore Justice Colinan. Finltilo (tiling to apicar as a prosecuting witnevthe case was adjourned for a few day. His jaunt of miles across the wastes of frozen anow and in the face of northern Dak La blizzards is not a Christmas frolic to be hankered after, and the alwence of the lieutenant will be regretted in many a festive gathering here and hereabouts. The case of OIley not Alley who stole the money from the trunk at Central, has assumed a funny phase. After his arrest I'belps, the man from whom the money was stolen, did not want to prosecute as until he committed this'oireneejlie had Iwcn a man in whom he had placed the utmost coijidtnec. The outing was one of thoee peculiar cases of temptation dm devil throws in a fellow's way omv in a while to get his harMKin into him. Olley was watching the house during the aWnce of Pbel and the housekeeper, and wishing to go up town he saw Pheljai' trunk open. Ho went to shut it down and lock it, and saw the money lying there.

He shut down the lid, took up his tidille and played a couple of tunes. Then arose, tsk the money and ski-ped out. The rest is familiar to the readers of the Pioneer.
