With interest we read Superintendent of Public Instruction Thomas D. Bailey's pamplct on proposed guides to teaching America's moral and spiritual heritage. I like many of the facts presented and it is heartening to know that those who administer public education funds are interested in America's moral and spiritual heritage of our young people. We agree that the state is not the purpose of our existance, that the individual does not exist for the state but rather that the state exists for the individual. The administration of public funds should be looked upon in this light.

Young people should. not be educated tor tne interest oi the state but rather the state hould assist the parents in educating young people in order that they may serve God and country. These spiritual ideals that are the foundation of our government come from many individuals with various religious and educational backgrounds. Religious concepts that are the basis of our government institutions, legal systems, social concepts and services for promoting the general welfare come from individuals, not from the 6tate. The state upholds and protects these religious concepts.

Superintendent Bailey has proposed a program for incorporation into public schools a factual study of religious concepts that are the basis of our American heritage, The individuals who put into effect these religious concepts had more than factual knowledge, they were inspired by faith in Divine Providence. Is is the duty of parents to give the young people the moral and spiritual foundations. The church and the state exist to help him. For the parent to recieve state assistance in giving his children education with a religious background is democratic. The parent assumes his responsibility in educating his children to his religious convictions.

The state assumes its proper function of assisting the parent in gaining educational opportunities for his children and in guaranteeing him freedom of religious guidance. The church remains the guarantee of the protec-tion of Almighty Providence and the storehouse and dispenser of spiritual values. The church should not be ignored in its desire to give young people faith in the religious guidance toward more inspired service. The principle of separation of church and state is good and works in the best interest of all citizens. This principle of separation does not mean that these two separate entities ignore each other, rather they assist each other and are mutually dependent on each other.

The state assists the church and its citizens by guaranteeing religious freedom and by protecting the church and its citizens from foreign powers and Communist anti-God doctrines. The church assists the state in giving the citizens the moral end spiritual values that make inspired leaders and law-abiding citizens, and by keeping alive the faith in an Almighty Diety that is the foundation of democratic society. The principle of separation of church and state is not violated when church sponsored enterprises receive assistance from public funds. Pay of military chaplains, the chapels and supplies come from government administered public funds. Government Hill-Burton funds have helped many Florida communities in hospital construction.

Pensacola's fine Bap tist Hospital was built with the as sistance of this government fund The parent-option tuition-aid plan with parents choice of prL vate sectarian or public schools will be a forward step in educa tion. The parent benefits by a free choice of schools to receive his children's share of the public edu cation fund. The children gain a nearer approach to the parents' ideals and benefit by a more ac tive parent-participation and in spiration in their education. Public schools on a basis of equality and not false superiority, with sectarian and private schools will benefit. Costly new school con struction and double sessions are a public problem.

Parents and church have fine educational buildings in use only a few hours each week. With parents' choice of tu- ltion-aid to pnvate, public or sec tarian schools, parents can use their children's share of the edu cation fund to give children edu cation with a religious background There will still be public schools for parents who choose them. The public will benefit by the parents free choice. Our state treasurer has announced that crime is Florida's biggest expense. Mr.

J. Si' LEAVING ASIDE the six months cf organization of the new appellate courts, the first full calendar year of experience produced this result: the Supreme Court disposed of 225 cases (writing an opinion in 52!) in 1957 and 505 twith an opinion in 210) in The figures from other states have not become available ibut the 19.77 statistics indicate Flor- Court's load. In 1957, for instance.

New York's top tribunal disposed 362 cases, writing pn opinion in 144. Justice Roberts said he did not believe anything was more important to the public than sound judicial precedents. "We have two sources of law: legislative law and case law," he explained. "Legislative law can change for many reasons the temper of the times, the influence of lobbyists, and many other ele ments, so legislative law is not necessarily the long, stable sort of the law that business can make invest ments on. You wouldn't plan a long! range business cm on net of the legislature 'cause it might be repealed at the next session, "But, brother, when a court re peals one ol its precedents, you hear a lot of howling.

People ex pect case law to be stable and to go on for ages -to become a mon ument. So if it is that important. and I certainly agree that it is, it should be carefully considered and well done. And I think that is be ing done now. "So I believe I can say to you trutMully that the judges are working just as hard as before, not producing as many cases but the 2 opinions of 1958 are no doubt worth far more to the people of Florida as legal precedents than the 522 of 1957 that were sort of born and developed in haste." I am sure that other mothers and fathers, as well as myself, are more than willing to be of any help they can in order to help their sons become members My son feels the time, since he became 8, has been wasted because he waited so long to reach the age to become a scout. If they must be out on a night like that they should know where to ride the bicycle as well as to have lights and reflectors on it. Their clothing should be of a light color, too. A yellow coat shows up at night much better than a black one. You say that talking to them doesn't do any good? Levan Davis, chairman of the Christian Emphasis Committee or the YMCA. How does it protect a man. woman or child to place with some one where he, she or it is not wanted? The dictionary says that to protect is to defend, guard, shel ter or shield.

How does integration in the public schools or elsewhere protect them since there is no violence and never has been. Sep arate but equal was placed in the Constitution in 1903 and no court has the authority to change it. It takes two-thirds of both houses of Congress and three-fourths of the states to change any part or even a single word in the Constitution. yet the present setup of low browed judicial misfits are changing it like a bunch of Navy men going to town. In the Fifth Amendment to the Constitution there appears this phrase: "nor be deprived of life.

liberty, or property, without due process of law." Actually this means that a man's life, liberty or property cannot be taken without a law having competent jurisdiction. The phrase "due process" means to get on with the case. Though any person who has read this and analyzed it can understand it, the Supreme Court actually used it to tear down the laws of Congress and supplement a law of its own, a piece of judicial dictatorship so brazen that the court constitutes itself a bunch of hoodlums so secure against harm as to cause Al Capone to turn over in his grave in envy. Perhaps the Supreme Court has the right to violate its oath but what right does that give Gov. Collins to vio let his.

The laws of the State of Florida are the business of Gov- nor Collins and he is under no obligation concerning any federal law any more than any good citi zen would have. When I say "Judicial Hoodlums" I mean just that. Never before has a gang been so completely lacking in self restraint. Never before has a group of men tried so hard to wipe out our written constitution only to substitute its own low browed, small town opinions. The constitution gives us the right to peaceably assemble to protect any act of government.

Up in Clinton the judicial dictator located at Knoxville made it a crime for three or more people to get to- gether and talk about the Clinton schools. From the looks of things somebody got mad.
