Rowland, his associates, successors or assigns, invested in the said water works, that the city council will eniict such other usual just, lawful and necessary ordinances as will effect that purpose. Section 12. Be it further ordained, That the said Arthur II. 4 mi Ar Sec. 2. Jie it further ordained, That the rights and privileges herein aud hereby conferred are tho subject of a contract between the said city council of Montgomery and the mid Arthur II. How lurid, his associates, successors or assigns, in hertin set iiuth. Sec.

3. lij it furil.i-r ordained, That the water so furnished shall ha clear, wholesome, deep well water.Miitablefor all domestic and ordinary mantilaotur-itg purpestsand sullident in quantity for all the Uses of said city and Inhabitants not exceed irg six million gallons per day. Kach ol said wells are to be so constructtd as to exclude all surface water or sewerage drainage, to be bored or dirven like artesian wells im 1 to extend to the same depth as the artei-iitu wells now in the city if necessary, Sec. 4. Beit further ordained; That the buildings to be erected for the; reception aid use of the pimping machinery of said wattr works shall be of brick withirou truss roots, the v.

hnlj to be neat, substantial nd every way suitable for the purposes for hk-Si they are. built. Sec. 5. Be it further ordain: That the machinery for said water works shall consist, lirst, of four ninety CM) horsepower boilers, capable, t-1' carrying a pressure of HX) pounds to the square inch.

The pumping engines ahull bo two in number, each capable of pumtint; a maximum quanty of four million gallons of water per diem against a es-sure of 130 pounds to the square inch. Each of thes engines shall be duplex, of modern construction, highly linlshed and lagged with black walnut; in connection with the above shall he all the necessary air pumps, conden er, to make a complete hiirh st ndarti pumping plant. The said buildings must be ample to contain the said pumping machinery and ilfty per cent, more, whenever necessary. Sec. 6.

Be It further ordained; That leading from this pumping station to Court Squ-ire there must, be a twenty-four incn pipe, and leading this pipe there must be other pipos ot suili-cb-ut size to tidly reach and supply all pins of the city; but the size ol the branch mains leauing from said 21 inch on Court street to the other ins of thecity is to be hereafter determined npon by and between the said city Council and said Arthur II. Ho land, nis associates, successors, or assignors beiore the work contemplated by this dec' ion is commenced, provided tnesaid council is represeuted in making Sii ii selection by a competent hydr iullc engineer. In estimating the water used by the city free of charge, the usual propsr add necessary instruments, recorders, shall be furnished and used by the management of the said water work-1, subject at all times t-j the inspection os the hy draulic engineer appointed by the city.

Sec. 14. Itj it fuither ordained, Thai, in consideration of these premises the said City Council hereby agrees to pay to said Arthur II. Howland, his associates, successors or assigns, for the use of the hydrants o. said water works for lire protection, the sum of eleven thousaud dollars per annum for all of the hydrants located oa the original pipe system herein provided for, to be paid in equal monthly installments during the existence of this contract, the use of all other hydrants hereinbeiore provided for to be free to said city Sec.

13. Be it further ordained, That the domestic riles for water turnished under this contract to the citizens of Montgomery shall never exceed the average rates pant in other cities of similar size; the present basis of such rates shall be six dollars per annum for a building of Uve rooms and less and one dollar per annum for each additional room, other rates to be proportionate to ihese, as above ordained. Said rates shall be such as to allow for the use of meters by consumers, if they so select. Ssc. Irt.

Beit further That the work necessary for the proper ul-lillment of this contract, shall be commenced by the said Arthur II. Howland, his associate, successors or ithin thirty days from the date ot the passage of this ordinance, and shall be practically completed within nine months after that time; and said Arthur II. Howland. his associates, successors or assigns, shall deposit with the City Clerk oue thousand dollars within twenty-four hours from the date of the pissage of Ibis ordinance, and forfeit the same If said work is not commenced as aloresald. 17. Be ir. further ordained, That at each recurring period of live years, after the date of the passage of this ordinance, said city of Montgomery may, if it so desires, purchase the s.ii.l wa'er works herein provided for; ami if the said city and ti said Arthur H. Howland, bis associates, successors or assigns can not agree upon the price thereof, then it shall be referred ta three disinterested and competent persons, one to be selected by ssid city, and one by the said Arthur II. Rowland, his succissors or assigns, and if these two cannot agree, then ihey shall select a third competent, disinterestod person, and the award in writing of a majority of these arbitrators thus selected shall be linal and binding upon the parties hereto, and perl.irmed and executed without delay.

IS. B. it further ordained, Tha' before any rent for any hydrants of the said proposed new water works shall be due or paid, the city at its discretion test the Mailt works, to ascertain if they are tllcieiit to furnish the lire streams he-, in specilled, and the works erected and constructed comply in all respects ith the terms of this Sec. Bs it further ordained, That the works herein provided for shall lie extended within reasonable time after the said city ahull notify in writing the said Arthur H. Howland, his assxiates, successors or assigns, that the said city has located one hydrant on each tenth of a mile of said pro-proposed extension, to be paid for ut the annual rate of llfty-llve dollars per hydrant.

Any additional hydrants which thecity may desire on such pro-poted extension, shall be located by the city and furnished, set and maintained at the expense of thecity as provided in section six of this article, and free of rent. fiec. 2i). Ha it further ordained, That when the water works herein provided for are completed stipulated for by said contract, that it shall be obligatory upon said city to use the hydrants of said wnW orks and pav for the sii'ne as herein before provided for, during a period of fifteen years; but this shall not HfTict any rights and privileges hen bi granted to maintain and operate mid water works In furnishing others than the fit v. Howland his associates, successors, and assigns shall so construct and continue the water works herein provided for in such a manner as to interfere as little as possible witn the public or private property in this city and shall Le liable for any damage or injuries to person or property caused by the negbgence of said iwlan-lhis associates, successor, and assigns or the agents of said Howland. bis associates, successors and assigns.
