CHEST By EDWIN TANJI Advertiier Maui County Bureau WAILUKU On May 5, 1976, the Maui County Planning Commission voted to deny a special management I area (shoreline) permit for a pro-I posed commercial shopping complex in Lahaina. On Dec. 5, 1977 19 months later the county planning department finally sent a letter to notify the landowner, Harry Weinberg, of the denial. The letter apparently was the only formal notification Weinberg received on the decision.

In a suit filed in 2nd Circuit Court, Weinberg now is seeking approval of his project based on the 19-month delay and the failure to provide a legal justification of the decision, as required under the Administrative Procedures Act. In the suit, Weinberg's attorneys note that the Planning Commission's denial of another project, also on May 5, 1976, was overturned by the court because of failure to provide findings of fact and conclusions of law. The two denials were the first such denials of shoreline permits by the Planning Commission. The second case involved the proposed Sea Habitat project at McGregor's Point. Sea Habitat was allowed a second hearing before the Planning Commission and received approval of the permit the second 5 plead guilty in HILO Five Big Island men have entered guilty pleas in 3rd Circuit Court to felony charges this week and two others have been sentenced for convictions last year.

Those pleading were: John Cando Camacho, 24, of Kona to one count of first degree theft of goods on a fishing boat Sept. 27. Three other counts were dropped. He will be sentenced by Judge Shu-nichi Kimura Feb. 28.

James Moikeha Galinato, 19, of Paauilo, to one count of second degree burglary for breaking into Pauuilo Store Aug. 29. A second burglary count was dropped. He will be sentenced by Judge Ernest Kubota next month. Brent K.

Kaniho, 20, of Waimea pleaded guilty to reduced charges of theft in the third degree and criminal trespass for stealing goods Nov. 13, 1976, from a Hilo restauarant. Kimura will sentence him Feb. 27. Eugene K.

Kahalewai, 50, of 140 Ululani Hilo, pleaded innocent to a nine-count indictment allegeding forgeries and thefts. Kubota is to schedule a three-day trial. Kahale Moon's pay suit HILO A Hawaii County councilman's suit to block controversial pay raises to nine cabinet-level officials on the Big Island has been complicated by a question of whether a county attorney can defend all of those named in the suit. Corporation Counsel Stephen Bess has deferred responding to the suit because of the question of conflict of interest if he represents the defendants in the suit. He has asked the office of the disciplinary counsel of the Hawaii Supreme Court for an advisory opinion as to whether he can ethically represent the defendants.

Officials in 3rd Circuit Court have allowed Bess a 30-day extension for defendant answers to the suit while Bess seeks the opinion from the supreme court official. At issue is whether Bess can adequately represent the diverse interests of the defendants who include Volcano men plea HILO Two Volcano men accused of shooting a 14-year-old boy and holding him captive afterward in a dispute over rights to a marijuana patch last October have pleaded guilty to reduced charges. The project was not built, however, because the develop-er later encountered difficulties with the site. In Weinberg's case, the denial was based largely on adverse public reaction to his proposed shopping complex and a conflict with the Lahaina Community Development Plan.

The development plan, which does not have the force of law, designated the site owned by Weinberg for a park. The hearing on the project request was held by the Maui Historic Commission, since the one-acre site is located within the historic district. Although a plannning staff report recommended approval of the project, the historic commission vote was 4-2 against the project. The Planning Commission later concurred with the Historic Commission in denying the project. Weinberg is planning a one- and two-story commercial development to be called Lahaina Plaza.

A former jail inmate was placed on five years' probation by Kubota for possessing marijuana in jail July 26 while serving a term for another offense. Lawrence Pagan, 23, was ordered to visit Kulani Prison and to write a report for the probation department of his experiences there.

Richard John Silva, 24, of Kailua, Hawaii was arraigned in district court on charges of second degree burglary in Kona Jan. 17. He is being held in jail in lieu of $1,000 bail bond. complicated finance director Stanley Nakamae, an appointed official; the mayor and several county legislators. Meanwhile, Bess has met with Hilo attorney John Burgess to discuss a possible out-of-court settlement in the dispute.

Burgess responded with a four-point proposal on behalf of Councilman Moon Sameshima who claims the pay raises were illegally granted by the mayor and then illegally approved retroactively by the council. Among the conditions he set was that Matayoshi pay for the costs of bringing the suit, including attorney fees, and admit to having violated the county charter.
