It is expected to be laid in front of legislators by the end of next week. THE BILL IS a compromise between 1971 House and Senate proposals for penal code revision. John T. Ushijima and Rep. Dennis O'Connor, co-chairmen of an interim committee appointed to study the code. O'Connor said he thinks both houses "will buy" the proposal. A major area of controversy was over marijuana.

The Senate had passed a separate act covering all controlled substances, while the House included marijuana along with all other drugs within the penal code. USHIJIMA and O'Connor said in effect they worked out a compromise. Classification of all controlled substances including marijuana will be under the State Department of Health. "In effect, this gives us local control," O'Connor said. Under the proposed code, possession of two ounces or less of marijuana would be a "petty misdemeanor," carrying a maximum sentence of a month in jail.

Possession now is a felony with a five-year prison sentence possible. O'Connor said "social gambling" is permitted under the proposal. "Mah jong, betting around the golf course, in the private home, no longer would be a crime," he said. THE BILL'S language is strict enough to insure that professional gambling will not slip in under the provisions, he said. Almost all prison sentences, including those for murder, will carry the possibility of parole.

Four crimes will permit lif e-without-parole sentences killing for hire, killing a policeman, killing a murder witness, killing in prison.
