Jury opts for life in slaying of two ASSOCIATED PRESS MOBILE A jury convicted Thomas Dale Ferguson of capital murder in the slaying of a Colbert County man and his 11-year-old son, then recommended a sentence of life without parole instead of execution after an emotional plea from his wife. "I'll never be able to be with my husband again, but please don't kill him," Karen Ferguson told jurors Thursday in a bid to keep Ferguson out of the electric chair.

A judge will decide later whether to accept the jury's recommendation or sentence him to death. Ferguson, 24, was one of five men charged in the July 20, 1997 deaths of Harold Pugh, 41, and his son, Joey, whose bullet-riddled bodies were found in Cane Creek near Barton. The Pughs were slain while on a fishing trip. The jury's sentence stirred anger among the Pughs' friends and relatives. Ferguson's trial was moved to Mobile County because of publicity.

"I hate to feel this way, but he deserved the death penalty," said Iris Pugh, who was married to the elder Pugh. "Joey and Harold will never be back. They never had a chance to have someone save their lives." Ferguson and a second man were accused of shooting the man and boy in the fishing boat. After the killings, Pugh's pickup truck was stolen and used in a bank robbery in Belmont, according to testimony. Ferguson was the second man convicted of capital murder in the Pugh slayings.

Michael Craig Maxwell, 25, Ferguson's partner in the boat, confessed to the crime and has been convicted of capital murder. He is scheduled for sentencing July 30. A Jefferson County jury has recommended he die in Alabama's electric chair. "I really wanted the two shooters to have death sentences," said Marilyn McWilliams, Joey's mother and Pugh's ex-wife. "I believe in an eye for an eye.

I think he should be put to death just like he put them to death. "The judge has the final word. He can still give them the death sentence. Believe me, I will be asking and pleading to him to give them the death penalty," she said. Ferguson's attorneys admitted he took part in the crime, but pleaded for conviction on a lesser charge and asked the jury spare their client the death penalty.

Defense attorneys portrayed Ferguson as a follower forced into the plot by his father-in-law, Mark David Moore, who is also charged with felony murder in the Pugh slayings. Ferguson told Colbert County investigators after his arrest that he was in the boat when the Pughs were shot but didn't shoot them. He said he got sick and began crying after they were killed. Trials for other three defendants are pending. Moore, 35, Kino Graham, 24, and Risley, 24, are charged with murder.

June 26, 1998.

Dr. Daniel practiced pediatrics In Montgomery from 1942 until 1966. During the polio epidemic here in the early 1950's he donated his services and organized the care of polio victims, Including operating nine Iron lung machines. Dr. Daniel served aboard the Hope hospital ship in Ecuador and for ten years served on its Board of Directors.

In 1966, he became Professor of Pediatrics at the Univeristy of Alabama School of Medicine where he helped to pioneer adolescent medicine. Dr. Daniel developed a multidiscl-pllnary approach to adolescent care, utilizing physicians, nurses, nutritionists and psychologists working together to focus on the overall health of teenagers. He wrote a widely used textbook, The Adolescent Patient. During his academic career, he received many honors and awards.

He was presented the highly prestigious Jacobi Award for lifetime service to children by the American Academy of Pediatrics and the American Medical Association. He received numerous honors as Director Adolescent Medicine at the Children's Hospital of Alabama in Birmingham. He retired to Montgomery in 1985. He is sur- vived by his wife, Jean Kimball Daniel and five children, William Andrew Daniel, III, Rollin Kimball Daniel, Jean Daniel Duck, Virginia Daniel Mitchell and Lillia Daniel Smith. Their spouses in order are Judith Wall Daniel, Beatrix Terkanis, Charles Patrick Carroll, Joseph William Mitchell and William David Smith.

He enjoyed the company of thirteen grandchildren, Anne Daniel Verreen, Allison Daniel, Andrew Nicolas Daniel, James Cameron Musgrave, Heather Louise Precise, Jennifer Duck, Sarah Elizabeth Carroll, Timothy Justin Carroll, James Daniel Mitchell, Lylan Kimball Mithcell, Lillia Starr Smith, William Chapman and Katie Beatrix Smith. A memorial service will be held on Sunday, June 28, 1998 at 2:30 p.m. at the Episcopal Church of the Ascension with the Rev. John Michael Van Dyke officiating. The family will receive friends at the church on Sunday for one hour prior to the time of services.
