J.R. Brooks, a special prosecutor appointed by Attorney General Don Siegelman, said Tuesday that the envelopes were printed and ordered with the knowledge of the Flippo campaign. The smear sheets, which contained derogatory remarks about four other Democratic candidates for governor, were mailed to Flippo supporters May 16. The envelopes were ordered from a Florence printer by a person who identified himself as Clayton Chiles, Mr. Brooks said.

There is no phone listing in Mobile, Montgomery, Florence or Huntsville for a Clayton Chiles. However, there is a phone listing in Mobile for Max Clayton Childs. Mr. Childs, in an interview Tuesday night, said his name was forged on a claim slip used to pick up the envelopes at the Montgomery Greyhound bus station. "I don't know anything about it at all, and I really hope they find whoever did it," Mr.

Childs said. "After I found out they forged my name I told the investigators if they made an arrest I wanted to charge them with forgery." Mr. Childs was a volunteer in Flippo's Mobile campaign headquarters but "didn't get real involved" in the governor's race, he said. "I helped them, but not real strong," Mr. Childs said.

Mr. Childs said he was questioned in mid-June by investigators from the state attorney general's office. "They told me that somebody had ordered some envelopes," Mr. Childs said. "They took a sample of my handwriting and all of that junk." Mr.

Brooks said investigators did not think Max Childs was connected with the smear sheet. i "We have interviewed him, but we do not think it is him," Mr. Brooks said. "The fact is there is A Max Clayton Childs who was a Flippo worker and whoever did it used Clayton Chiles." The envelopes originally were to be shipped by bus to Mobile, where they were to be paid for on delivery, Mr. Brooks said.

However, a person who identified himself as Clayton Chiles intercepted the envelopes at the Montgomery bus station and R'aid for them in person at 9:30 p.m. on May 2, Mr. Brooks said. tu i i i in; man wiiu fjif-rvtru uiy tuc envelopes is between 5-feet-8 and 5-feet-10 inches tall, weighs a))out 175 pounds and has medium length, light brown or graying hair, Mr. Brooks said.

The suspect is between 40 to 45 years o)d, Mr. Brooks said. Mr. Childs said he is 61 years old, weighs about 210 pounds, is about 5-feet-8 inches tall, and hias brownish-gray, but mostly gpay, hair. "(Max Childs) does not fit the diescription," Mr.

Brooks said. 'Mr. Childs is a retired police ohicer for the University of South Alabama and is an elected constable from Mobile County. He initially ran for Democratic Party chairman but dropped out before the Aug. 4 party meeting when Jack Hurley was unanimously elected chairman.

'Rick Dent, a spokesman for Mr. Siegelman, said the Attorney General's1 Office is satisfied with the investigation. are very pleased with the progress that has been made and certainly this office is committed to expending the resources and funding needed to finding out who is responsible," Mr. Dent said. Flippo, who placed fourth in the June 5 Democratic primary for governor, repeatedly has denied any knowledge of the origin of the smear sheet.
