SILENT VICTIMS. Mavfair Flat Crime Sentence. The trial was concluded at the Qld Bailey yesterday before the Recorder (Sir Ernest Wild, K.C.)' of Roland Bateman (22), an ex-Guardsman, who Was charged with wounding Mr. Philip Eaton, an American professor of chemistry, with intent to murder him in a flat in Hall Moon Street, Mayfair. He was also charged with robbing Mr.

Eaton of notes and clothing to the" value of 42. James Moore (22), soldier, was accused of stealing and receiving some' of th8 articles, well knowing them to bo stolen. Both men have pleaded not guilty. The case for the Crown was that just after 10 30 on tho night of August 12, before going to bed, Mr. Eaton took a walk in Piccadilly.

The next morning ha was found in bod semi-conscious, covered with blood suffering from five severe wounds in face. The bedroom showed signs of disorder, and trunks and drawers had been opened and the contents rifled. In his walk in Piccadilly Mr. Eaton and met a man he could not now recognise. The defence of Bateman was justifica tion for the alleged attack.

He alleged that after lie had been plied avith. whisky, suggestions were made which sent hun mad," and he struck out, hardly knowing what happened. Summing up, the Recorder said that something had been stated during the hearing of the case about drunkenness. It used to be eaid that drunkenness wna no exouse for crime, but that statement had come to be reconsidered somewnat by the judges. Commenting on the defence, the Recorder pointed out that it was suggested that what Bateman did was done in self-defence.

But the jury would have to consider if Bateman were telling the truth. Certainly the wounds from which Air. Eaton suffered were hardly commensurate with that declaration. Taking the law into one's hands was not permitted in this country, neither was revenge. Th only vengeance that was recognised in England was the vindication and eniorce-ment of the public rights in the courts of the King.

A Hyde Gang. The jury found Bateman guilty of robbery with violence and Moore guilty of receiving the stolen property. Divisional Detective Inspector Bradley said that there was no previous conviction recorded against Bateman. He was bom near Pontefract, and after working at a colliery he served in the Coldstream Guards for thiee years, after which he was transferred to the reserve. He was employed for two Veeks as a porter on the Undergiound Railway.

Since then ha had been keeping in the vicinity of Hyde Park and associating with undesirably characters of -both sexes. The Recorder: Is there -a whole gang of them? Inspector Bradley Yes, my lord. Have you got them under observa tion? Yes. Inspector Bradley added that tin police received manv complaints con cerning these people-, but unfortunately their victims would not come forward to assist the police. The gang got into conveisation with men and lured them into side turnings and often stole their watches and correspondence and visiting cards for tho purpose of blackmail.

The Recorder: Are any of them soldiers? Some of the men are ex- soldiers and some are serving soldiers. With regard to Moore, Inspector Bradley said that his character was good. He had served in tho Irish Guards, and he was wanted as a deserter. Ha understood that the military authorities would take him back, but they were waiting the result of this trial. In reply to the Recorder, the Inspector said that Moore was also an associate of the Hyde Park undesirables.

The gang kept it up until two or three o'clock in the morning. They slept in the park in fine weather and got into conversation with people-. "Terrorised" Witness. Replying to a further question from th Recorder, Inspector Bradley said that nothing was known against the character of Mr. Eaton.

He had seen many people who had known him for many years and they all spoke very highly of him. Inspector Bradley added that the kind of offence to which he had alluded was again on the increase. Five years ago it seemed to die out, but during the last eighteen months the police bad again received many The Recorder These men generally go about for this express purpose? Yes. One hears of the boastfulness of these men regarding what they got out of it and they generally hhare what they got between them. Questioned about two witnesses wht failed to attend the trial to give evidence, inspector Bradley said that he understood one, a woman, was afraid to come to the Old Bailey.

The Recorder: Do you know wh terrorised the woman I don't know, but I do know that these men are greatly assisted by women. In the interests of the public will yon keep your eyes on them Ye3, my lord. The Recorder said that the jury, after a long trial, had acquitted Bateman of the wounding charge. The responsibility was theirs, not his. Bateman had been found guilty of one of the gravest offences known to law, the maximum sentence for which was penal servitude for life and a whipping.

Bateman went to Mr. Eaton's fiat and drank whisky, robbed Mr. Eaton with violence, and left him for dead; It was luck'y for him that he was not charger, with murder. Inspector Bradley's evidence made Hyde Park and ifs vicinities appear to be more dangerous places than they were supposed to be. He" would pass" on Bateman the least sentence he could commensurate with tha offence, which was three years penal servitude.

He would give Moore chance) of becoming a man again, and would postpone sentence on him until November Sessions in order that tha probation officer might see if eomething could be done, for him, providing the military authorities took a favourable view of his case. CAR THROUGH SHOP WINDOW. Shock for People at Lunch, A motor-car skidding on the tram-lines in Streatham High Eoad at lunch-time yesterday mounted the pavement, struck Frederick A. Willis, a window cleaner, wno Teas on tne pavement carrying a ladder, and flung him through the window of the Carlotta tearooms. The car ploughed through a mass of confectionery and cutlery-ware, creating panic among people who were lunching on the premises. Willis was afterwards treated at St.

The manageress of the tearooms a reporter that there was consternation anions: the customeis. but the greatest shock of all was sustained by one of the rssistants, who had a marvellous escape. The girl had been on the window counter for some time arranging a display and had just stepped off to" the floor when the ear clashed through the window. She had a miraculous escape and is suffering from shock.

The car went right to the counter and smashed everything in its way. CONVICTION QUASHED. Doubtful Evidence Regarding Balance-Sheet. Mark Hochglick, who was convicted at the Central Ciiminal Court and sentenced to 12 months' imprisonment in the second division, successfully appealed against the conviction at the Court of Criminal Appeal yesterday. Lord Hewart said that Hochglick, who was convicted of obtaining goods by false pretences, was a silk merchant who ceased trading on May 1G.

Early this year he was in financial difficulties, and in June he was adjudicated bankrupt. In February he iiad a balance-sheet of his business prepared by an accountant, and the false pretences alleged against him were that he falsely pretended that he was solvent, that he was earrvine on a genuine business, and that the balance- sheet truly represented his financial posi uon. The point of substance in the case was whether he oroduced a ial3e balance-sheet. A sum of nearly 4,000 played a material part in tne and an accountant gave evidence that 3,300 of it, was explained- It became common ground that with regard to that sum the prosecution could not establish their case. 1 was no evidence on which the jury could find that the balance-sheet was iaise to HochslicK knowledge.

The Recorder, in his summine-UD to the jury, indicated that the 4,000 was a side issue, and left it in doubt whether the evidence on that point was correct. The eTidence about the 4,000 was not fullv and clearlv explained, and in the circumstances the conviction was unsatis factory' and comd not be sustained. The appeal would be allowed and the conviction quashed. .3,000 FIRE DAMAGE. Damage estimated at 3,000 tras caused yesteaday by an outbreak of fire at the gaa aad engineering works st Stockton-on-Tees of Messrs.
