Dec 5 The claims of a group of San Joaquin Valley residents headed by Morrow of Fresno to rich Ket-tleman Hills oil lands under lease to the General Petroleum Corporation of California stand denied today in a decision handed down by Superior Judge Van Zante The claim based on a twenty-six-year-old agreement with the late Ochsner for the development of the land was denied on the ground the action is barred by the atatuta of limitations Another ground was the opinion that the United States should have been made a party defendant Judge Van Zante ruled the defendants have no claim against the General Petroleum Corporation and also granted the motions of two other defendants the Universal Oil and Land Company and the California Kettleman Oil Royalties Inc for a nonsuit as regards them Case Waa Heard Year Ago Judge Van Zante had had the case under advisement since early in the year The trial was begun here last November after the com- Jiletion of a similar trial in Fresno which Federal Judge George Cosgrave denied the claims of the same group as well as of the Medallion Oil Company to a large acreage Including the 480 acres involved in the present case Morrow was one of a group of prospectors who had claimed the land under the placer mining law They made an agreement July 30 1910 with Ochsner whereby they deeded him half the land on condition he obtain a prospecting permit and an operator to drill the land A well was drilled in the area by the Medallion Oil Company and later abandoned Afterward Ochsner obtained a permit in his own right and assigned it to various oil companies A lease was finally given by the secretary of interior to ths General Petroleum Corporation in 1931 Land Not Developed Since the organization of -the Kettleman North' Dome Association for unit plan operation of the field there has been no development on the tract The General Petroleum has however received a share of proceeds from the association pool and it was this fund the plaintiffs sought to reach They claimed half of all the money the corporation had received for the claimed 40 acres in Action £22-18 The ruling the United States should have been made a patty to the suit was made by Judge Van Zante on the ground the government gave General Petroleum a lease granting the exclusive right to drill on the land With respect to the statute of limitations the court held that it began to run as early as September 1923 but the plaintiffs did not assert their claims in court until about six years ago Plaintiffs Are Listed The original group of locators weie James Neal and John
