i The action of the Legislature on banking matters is likely, from present appearances, to be very scanty at this session. The only bill of any consequenoe that has got through' is that imposing heavy pains and penalties on bank directors, individually, for the violation of the of in getting "out of lins," as called that is, 'In failing to have on hand always an amount equal to one-third In specie, and two-thirds in specie funds, discounted paper and exchange, ot all their eash liabilities. This rule has been violated, not unfrequently, by some of the chartered banks, during the past year. The faot was reported to the Legislature by the Board of Currency, and the standing committees on banks, in both Houses, reported a bill, whioh passed with scarcely any opposition, to im pose heavy personal penalties upon the individual directors, for any future transgressions. It has not appeared that these deviations from the law were caused, in the slightest degree, by any weakness of the or had been of the smallest Injury to the publio on the contrary, it was manifest that they were caused by the great pressure of the business of the community, and were, in faot, safe operations, and of great convenience to the public But they were of evil example as breaches of positive law, and disturbances in a general rule, which is looked upon as essential to the safety of the currency, and therefore an element in that confidence whioh has been reposed in our banking, as the soundest in the Union.

Instead of modify. irg the case, or varying the rule to meet a case of present publio oonvenienoe, the Legislature has strengthened both with very stringent provisions. The effect will be to fortify the publio faith in the security of the Danas, ana tne enure soundness and immediate convertibility of their issues. But it will have the further effect of restricting their operations, more than Is measured, by the excess of their issues, during the past year, or by the temporary excesses to whioh their movement has been liable. The severity of the impositions to which every deviation from line is now subjected, will require a degree of caution that would act sensibly on the general amount of their operations.

They must hold themselves so guarded at all times, that a temporary departure from the rigid, rule may not happen by aooldent, and it will be easily comprehended by any one at all acquainted with banking operations, how easily a bank, perfectly well fortified one day, may, by unexpected calls of business, be out of line the next, unless it maintains a large and constant reserve, that acta as a restraint upon its operation. This is not suggested as a plea against the soundness of the rule, or the propriety of maintaining it, so as te be always effective to control the action of the backs. But it is an important practical fact for the consideration of our business men that there is to be a change in the administering of the most powerful of our institutions. Hitherto confident in their strength and their ability to reinstate themselves within line, they have sometimes extended themselves so as to risk the danger of temporarily disturb ing the balance which the law demands between their cash aasete and their cash liabilities, and consequently been frequently in excess, although they have always recovered very speedily. This can no longer be risked, and to the extent of the precautions which the new conditions require, in order to escape the heavy penalties of even accidental transactions, the facilities to commercial men must be reduced.

This is the one direct measure whioh the Legislature have passed, having as its influence to contract sensibly the banking facilities of the city. Two other measures were before them, of which the effect was the increase of banking facilities. Both have failed. On was. the act to equalize the loan to mortgage stockholders of the Citizens' Bank by an extension of $500,000 of the State bonds, due in 1859.

The whole amount due is $1,225,000, and the mortgage department of the bank will be prepared to pay it when due to the holders, who reside abroad. For of this sum it was proposed to ask an ex tension by a renewal of the bonds of the State lor that amount, at twenty-five years money to be retained by the bank and distributed as loans among the mortgage stockholders; who failed to obtain the loan to which they were originally entitled under the bank darter. The proposition was to retain thij $506,000 for the uses of the bank in that form. It passed the Senate, after a smart struggle being resisted as unconstitutional, revolving in fact a loan of the State credit for banking purposes, in violation of article 1(8, which prescribes that the State shall not subscribe for the stock of, nor make a loan to, nor pledge, its faith for the benefit of any corporation or joint stock company, created or established for banking purposes." It was held by many that the renewal of a bond while a banking company is ready to pay, is in substance a new loan of the public credit but the Senate thought otherwise, and passed the: bOL It I went through the He use and passed to a third reading, one day last week, with but a majority, but its success was considered certain. It Jbas accordingly been passed over without any consideration of its merits, for a more elaborate review and discussion before the public, i ne next legislature will, we trust be ready to meet it understanding, and it will have the benefit of additional ex perienoe and the concentrated opinions of the business men of New Orleans to oonvinoa -them that legislation is absolutely needed to harmonise the banking laws of the State with each other, and make them available for the pressing needs of the expanding commerce of mew urieans.
