He claims the endorsement of the New Alliance Party of New big parties." Serrette said he endorses Democratic contender Jesse Jackson's stands on many -issues, but said the Chicago preacher does not go far enough in his representation of poor people. "Poor people can't get anything from the Democratic Party," he said. "Their only choice is the threat of an alternative party." Like Jackson, Serrette hopes to garner votes through a "coalition of women, gays, Blacks, Latinos and the poor." He held out the possibility that he would consider dropping out of the race if Jackson loses the Democratic nomination and forms a third party effort for the presidency.

Serrette calls his campaign a grassroots effort that depends on friends rather than expensive motels for overnight accomodations and travels by car rather than airplane. "We believe we have the pulse of the people," he said. "We may be the surprise sleeper candidate." Serrette said he is on the ballot in 11 states and has more than enough signatures on a petition to qualify for a spot on the Alabama ballot. "We will be on there by the end of the week," he said. He criticized Democratic and Republican economic and defense platforms and said he would "subtract dramatically" from the defense budget.

"The whole idea of defense is money-making gimmickry to build arms that will never be used," he said. "That money could be spent on social programs." He said he would encourage business attitudes that value "people before profits." Serrette said he already considers himself a winner "by virtue of being out here, igniting the idea of an alternative party." The council voted to change the zoning of a lot on the north side of Shirley Lane from residential to commercial so that Pruett's Garage, an automobile repair shop that has been located there for several years, could continue operating. A.E. Wood, who has lived across from the lot for eight years, filed a lawsuit in Elmore County Circuit Court several months ago asking the court to stop the council from rezoning the residential property. The case is pending. Wood claimes that he tried to sell his house, but the deal fell through when the potential buyers were denied a loan because the house was located near a business.

The council also heard comments favoring the zoning change from the business' attorney and from residents with property bordering the garage. "This is certainly not any exclusive residential area," said Bill Reneau, the Wetumpka attorney representing Pruett's Garage in the lawsuit. "We're not hurting the residents of Shirley Lane one bit to have the Pruett property rezoned. "But it will certainly damage the Pruetts if they have to give up their business." NEW ORLEANS (AP) A federal appeals court was asked Monday to delay the execution of Johnny Taylor of Prichard, a convicted murderer whose date with the electric chair was less than 35 hours away. The three-judge panel of the 5th U.S.

Circuit Court of Appeals heard the plea three hours after U.S. District Judge Martin Feldman rejected Taylor's latest appeal as "fanciful." Attorney Frank Sloan, who took over the 30-year-old condemned prisoner's case on Feb. 15, concentrated on a claim that the defense lawyer at the 1980 trial was incompetent. This was regarded as the best bet for a stay for the 30-year-old condemned prisoner because the U.S. Supreme Court may, in a case now pending before it, set guidelines for determining when a trial lawyer was incompetent.

In situations where similar issues are involved before the Supreme Court lower courts frequently impose delay to see what the justices are going to say before ruling. Sloan said if he lost here the next step was a desperation plea to the U.S. Supreme Court. The claim of trial lawyer incompetence has become a common element in death penalty appeals. With hindsight, it is an easy accusation to make, difficult to rebut.

However, Sloan was sharply questioned by the panel. At one point, Judge Alvin Rubin of Baton Rouge, said Sloan was before the court with nothing to back a plea for a stay but saying, "I haven't had a chance to research it but look! there are all these possibilities floating around. And if you give us another 60 days I can find them." Sloan argued that it was plain that James Manning, the trial lawyer, did not do all that he could have done. He said Taylor did not raise the popular ineffective counsel claim in his first appeal because he didn't know it was one of his options. At the earlier hearing, Judge Feldman said bringing up the claim of ineffective counsel in a second appeal, after losing the first appeal, was an abuse of the legal process.

Feldman's ruling Monday morning marked the second time, on successive appeals, that he had denied Taylor's pleas for retrial. He rejected the first appeal on Feb. 15. Both of Feldman's rulings were appealed to the 5th circuit, which waited until this second plea caught up with the first one before holding its hearing. In this latest ruling, Feldman said federal courts should not be "intimidated" into granting delays for extra hearings based on what he called fanciful claims.
