By JOHN OMICINSKI Cam Nm Service ALBANY About 8.5 million New Yorkers fewer than were registered four years ago will be eligible to vote Tuesday, the state elections board estimates.

There will be about 700,000 fewer voters eligible to cast ballots in the Jimmy Carter-Gerald Ford contest than there were in the George McGovern-Richard Nixon race four years ago. The figures indicate that the sharpest registration dropoff is in New York City. There, about 500,000 fewer will be qualified to vote this year than in 1972. The falloff comes despite a new mail registration, program and aggressive efforts, particularly by the Democratic Party, to get people registered. The figure is just slightly more than the 8.35 million who were eligible to vote in 1960.

Meanwhile, the roster of candidates for the presidential election in New York still isn't complete. Independence Party candidate Eugene McCarthy is trying to take his battle to get on the state's ballot to the U.S. Supreme Court. Although the state Court of Appeals, New York's highest court, ousted McCarthy from the ballot in a Wednesday night ruling, Chief Judge Charles Breitel allowed McCarthy a one-day stay of the order yesterday to pursue his appeal to the nation's top court. i 7 -i McCarthy's attorneys are seeking a hearing before Supreme Court Justice Thurgood Marshall in an attempt to reverse the state court ruling, which said the Minneso tan's nominating petitions didn't comply with procedures set forth in the state election law As McCarthy sought the hearing, state Elections Board Chairman Stephen May said the McCarthy situation may eventually lead to changes in the law.

"I think it would be very healthy to review present procedures to see if there are better ways to qualify candidates while keeping safeguards against fraud," he said. May and the board have been called upon to referee several disputes this year on nominating petitions, including one involving Rep. Peter A. Peyser's effort to run a primary against Sen. James L.

Buckley for the Republican nomination. Peyser, after a legal fight, qualified for the primary but lost it by a wide margin. May also would like to see changes in the election calendar to allow local boards of election to gear up for the voting quicker. This year, the roster of offices weren't sent from Albany until Oct. 8 because the petition period, and challenges that followed, stalled the process.

In some cases, the candidate lists didn't reach local boards for a week because of mail. This meant absentee ballots, in many cases, weren't mailed until last week, so some absentee voters may not be able to return their ballots to local boards by Tuesday.
