Smith Appeal from Orleans The defendant was prosecuted on two counts: 1. Shooting with intent to murder; 2. Inflict-isgawouud lets than mayhem. The jury returned a verdict in the following words: Guilty shooting with intent to murder." The defendant was sen lanced to three years at hard labor. He appeals.

Tney accompanied their petition witu one signed by eighteen owners of property in the Immediate neigh-Dornood expressing the opinion that no in jury would result, and approving the grant ing oi toe permit.

The plaintiff sought an injunction to restrain the defend ant from proceeding to erect any steam engine, boiler or appurtenances thereto ou the premises. The lower court refused the injunction. The Judgment is affirmed, principally on the grounds that an Injunction will not lie acrainst a prospective nuisance, except in cases where its establishment will occasion imminent danger or irreparable injury.

Joseph street, under said act, bat that it did not prohibit the city from granting such authority. In absence of any allegation or proof that defendant's railroad is improperly constructed or conductad, or tutaa defective machinery, or, ia any way, occasions injury not incident to the pendent anl lawful exercise of its right, plaintiff la not entitled to the injunction or damages claimed. An action of damages will not lie for merely consequential Injuries resulting from the pursuit -of a business and exercise of rigats, lawful in themselves, when they are exercised with pruaenoe and caution and im a manner to cause no unnecessary injury. Such inconveniences or injuries must be borne as the tribute of individual inconvenience to the general good. Article IM of the preeeat constitution Is not applicable to this case.
