Notwithstanding the admitted great talents of the Earl or Derby niineeu, and tne many eoaeeaeions he was willing to make of t. I .1 1. 1... .1 opposed bo long, the great influence of Pro testanl, feeling which he had succeeded iu en listing in his behalf, and the vast moneyed influ ence and Crown patronage innnence wuicn a conservative Cabinet in power can always yield, there has been from the day of his accession to office a universal persuasion that it could not stand the ordeal of a popular election. In fact, the Derby Administration cauie iu as a minority, because its adversaries were distracted, and the existing Government enfeebled by their own dis i i seosious, and baa, by a series oi pouiicai weas.

neeses which loet them the public respect, had dispersed themsel vee rather than tx eu turned out by a triumphant parly. Taking an office which had been dropped, rather than assuming it on any na tional call, or any national isoue. the Derby Cabinet adopted no clroiig or distinctive policy, made uo attractive or bold isetue but rather offered i'self as a transition ministry attached to obsolete principles, and anxious to restore tbcm but wil ling to surrender them if, after another trial, they should be beaten again. As an acting admin istration, however, it marked itself, during the few months of existence permitted to it by the indulgence of its opponents, as oue of great bttw uem decpatrb, having carried through many im portant bill much needed for tbe public service rhi a great point among their parti zane, but is remembered that they cauie iu with a large amount of regular buctuess, prepared to their hands by their predecessors; aud, beaidee, the wiudiog up of a loug Parliament necessarily, like the close of a long Congress, forces attention to many tUiiigb which would otherwise be The Miuibtr' further damaged itself in two im portant particulars. If there be auy tiling which more than any other feed tbe national pride of the British people, it id the immunity which they claim for their fellow subjects, all over the world, aud the vigilance with which they exact from their Gotcrnineut the most promi.t interference to protect an Englishman against iujus lce or injury from any other Government The Earl of Malmesbury, the I 'oreigu Secretary of the Derby Ministry, has had tue misfortune to mismanage two important cases iu which this principle was rupposed to be involved.

In the case of Mather at Florence, aud iu regard to the treaty with trance for the mutual extradition of criminals, some of his oivu party journals were compelled to apologize for mistakes, and the opposition found ample material for raising pop lar suspicion and dislike. After so daring and thoroughly British a statesman as Lord Palnier ston, who always, ou the first tidings of wrong to one 'with an English name, interposed the arm of his Government to secure him all possible protection, tbe compromising and hesitating policy of the Karl of Malmeabury marie a poor figure and sadly weakened the estimate of the energy of the Derby Cabinet. Indeed, it was thought at one time that the Foreign Secretary would retire, for the purpose of bringing in a stronger man in the person of Lord Redville, ately Sir Stratford Canning.) The other grand mistake, as it seenia here, of the Earl of Derby, was his anti Catholic proclamation, not so much for the particular act, objectionable as it is, and dangerous as the couae qnenceii have proved It to be, as from the general alarm it created, that an intolerant, prescriptive. no popery spirit was about to be infused into the whole administration. The anti papal prejudice in England isntrnng indeed, in high quarters and among influential classes; but the worst and most dangerous manifestations are apprehended from the lower classes, who are not voters, and whose political weight in the elections is by no means an equivalent for the peril of riotiors and disturbances of the public peace, murders, rol beries and arsons, to which the fomenting of these religious animosities invariably leads and thus, among the moat decidedly Protestant classes, a feeling of insecurity, no less than a natural repugnance to persecution, has aided to lessen the small chance which the Derby Ministry had of being retained iu office by the popular voice at these elections.

The experiment of making an administration, without distinct principles or definite objects, held together by the simple cohesion of office, ready to accept and administer any system of policy Parliament may offer, has failed totally. The returns, though by no means complete, indi cate that Ministers will be largely iu tbe minority: and that, after the assembling of tbe new Parlia ment, nothiug but the ceremony of a vole will be required to signify to them permission to retire, Whether that vote will be given at once, in, bow ever, a matter of doubtful speculation. To vote that the House of Commons ha uo coufideiicu in tbe Ear! of Derby ould be an easy matter, if it did not carry with il the uecetsiu of designating some per ton in whom they have confidence and il will require a good deal of good management among his adversaries, a good scheme of popular policy, and a good programme of an administration, to be formed and readv before this step will be taken. Thn news is interesting. The following from the Polynesian gives some particulars of the massacre of the crew of an American sloop at the Gallipagt Islands an I Uie destruction of the vessel by the convicts si Chatham Inland, which the editor learned from Capt Heath, of the bark Pesrador, from Val paraiso About the middle of November last, the sloop Phantom, Capi. Kendal, of San Francisco, visited that island for a cargo of turtle. A boat was sent ashore with all the crew except the captain, mare and hoy. While thus weakened, a boai with five convicts came olt attacked the vessel and killed the male on observing which, the captain jumped overboard, but was pursued and killed in the water.

The pirates then returned to the vessel, killed the boy and plundered the vessel. Money to the amount of or was supposed to have been on board. After robbing the vessel of all they wanted, she was scuttled and sunk. The party on shore were all killed by the convicts, who qnarreled among them 'Plves and killed one of their own number. Capt.

Heath saw on shore a chronometer, the miniature and clothes of Capt Kendal, and was inlormeu by the buglisii captain of a Spanish brig that two of the perpetrators of the in as sacre had been apprehended, and that the other two were still at large in the mountains. The only intelligence respecting Floreaa affairs is that the Peruvian Ministry has been changed, and that the present Cabinet is opposed to Flo res, and will afford him no protection or assist an ea. He is said to hare 9M men under him. Valparaiso is said to be iu a most nourishing condition, and the advices from other quarters are of trifling importance. Since writing the above, the following letter, which contains several items ot interest, has been handed us bv the V.

S. Consul, David M. Corwine, Esq. It presents a brighter aspect of Floret's position than general intelligence heretofore furnished to us: II. S.

Skip Postsjcoch, ten miles below Guayaquil, June 10, ISZ. Dear Sir I wrote you on the 2d ult that v. should probably be with you by the 25lh iust. Since that time, matters have taken au aspect more alarming to Guayaquil. The Quickstep has joined Florcs, with a number of troops said to be Ajncricau how many is not kuown here.

Flores has lately received a reinitlaure of from Lima, and'it seems probable that Peru will furnish him with more moirey and men. The V. S. Charge at Guayaquil has protested against our ehip leaving this river at th present crisis and Capt. Doruiu will wait for further instructions from the Commodore, before sailing for Panama, should Flores continue to hold his present menacing altitude.

Thi stal or things cannot last much loueer. As soon as practicable we shall sail for Panama, to which port the cap I tain and officers are anxious to go. I Very truly, yours, H. BniDr K. D.

A petition has been filed in the District Court by counsel for Constance Leconipte, wbo pcaya that a wr.t of tiahcat rermu be issued, and It. 2.1 be or discbsrged fmm tbe Work Bouse, ta wbicb be lias ueen committed by Recorder Oenois, on the charge of vagrancy. The ground of the application is that Le rumple hss arked fur a Uial by Jury, and that tbe Recorder had no authority to sentence him to Imprisonment in the Work House.

Tbe case will come up for argument tomorrow. The Recorder have lately adopted tne plan of sending vagranta wbo demand tbe privilege of a trial by jury to I be Work House, instead of tbe Parish Prison, justly concluding that tbey should not be a burthen oa the community, sod should labor for their own support. The opinion ia beginning to prevail that all persons imprisoned should labor, and It is sustained by tbe remarks of Judge Buchanan, when during tbe illness of Jodge Larue, some time since, be sentenced persons to tbe Penitentiary, and orated thaf it were better for tbem and tbe community thai tbey ahoold do something while confined towards their own aupport, than that they should live In Idleness. If the Recorder have not the power of tend ng vagranta to tbe Work House to await trial, it ia time that the authority should be vested in them. Two petitions have been filed In the Fourth District fur writs of Kabcat ci'rput, and both will be argued to mor row before Judge Reynolds.

Tbe police have lately, in tbe several districts, arrested women of bad repute, and when taken before tbe Recorders these women hae generally been fined or imprieoaed ia Oi Work House. Counsel for them have contended that the police have no authority to enter their houses snd arrest tbem, when no other cuarre is alleged than that tbey are lewd and abandoned, and we learn that the question will son be trsred before one ef tbe inde Jtau rivrd I On tje iid by the Eev.
