Hence the question arose, in what manner did the loss result. The power of the Legislature to deprive the people of Uus city of the right of drainage en joyed by them as a natural servitude, and re cognised as theirs, was discussed.

The action was brought against the city to recover dam ages tor having, continued to drain into said canal after the expiration of five years. Mr. Gabernator had been subrogated to the rights' o. the Carondelet Canal and Navigation Com pany. After, much argumfnt the case was submitted.

Xegrotto, J. Yiosca, and A.

Beimoneny, claimants and owners, who put in, a general denial, claiming specially that plaintiff put into the vessel, a propeller, machinery that was defective, and they claim ed also, in revendicatkm, $28,600. The court charged the jury as follows i This is a suit based on a contract. If the contract has been complied with if' the en gines and machinery placed ott the steamer have been: accepted, by the defendants, then the plaintiff is entitled to a judgment in his favor. An unimportant deviation in the ex ecution of the work, if that deviation has resulted in advantage to the defendants, cannot -vitiate the contract. N.
