On consideration of the numerous application lor rehearing this cause, we hare discovered several errors which have wept into nr review of the very complicated and almost innumerable issues presented in the multifarious pleadings contained iu this record. Uenue we nave concluded to re- open tne case in order to make necessary corrections.

On Renearlnc In order to facilitate a vroper execution of the Judgment, we recast the decree to its entirety although the cor-lections are intended to affect certain portions only. It Is therefore ordered, that our previous decree be annulled and set aside, and tnat tne following decree be rendered in Its stead It is therefore ordered, adjudged nd decreed tunc the judgment appealed from be amended in the following particulars: 1. That said judgment. In so far rs It exonerates Moses Co. and Mr.

Frank from the payment of Interest on their purchase, as It denies the ownership of appellants to the mortgage notes wliich trey claim to hold, and insofar It maintains the action of Wlltz, Public Administrator, for the simulation pro tanto of tne act of mortgage uuder which appellants declare, be annulled and avoided. It is further decreed 2. That 6-24 of the principal of the fund realized be set apart for the benefit of the Qermania Bank, as holder of note is for 1-34; of David Koos, as holder of notes 14 and 18. for 2-24, and Jutius Meyer, as bolder of notes 8 ana 9 for 2-24. 3.

Tuat out of the residue, 19-24, J. C. Morris and the Canal Bank, aa holders of notes 11, 12, 13, 13, 10. 17, 20, 21, 22, 23 and 24 be paid in full ana by preference out Of tue amount accruing to and remaining over to the credit of Henry Koos as holder of notes 5. 7 and 10, and of the Uer-lnanla Bank as holders of tue notes 1.2, 3 and 4.

4. That Moses Lobe Co. and M. Frank be condemned to pay interest at the rate of per cent, per annum from June 18, 1881, on the balance remaining due by them nn thA rmnMlli amounts at their purchases, to the extent of the aggre- cate auionuts of the residue of the purchase Jirioe accruing to the notes held by appel-ants. as follows: Of notes 9 ana 9 hefa by Julius Meyer, of notes 14 and 18 held by David Koos, and of notes 6, 6.

7 and 10 held by Henry Koos. 6. That the Recorder of Mortgages be ordered and required to cancel and erase the said conventional luongsge executed by B. Cain on 'Feb. 25, lo78, and the legal mortgage resulting from tue registry of the marriage contraot between L.

H. Cain and Caroline Cain, In so far as it affects their property, as soon as Moses Co. and ii. Frank shall have complied with the terms of this decree. It is urtner ordered that In all other respects and particulars the judgment appealed from be alliruied and made the Judgment of this court.

It is further ordered that all costs below, incurred in the action of Wilts, administrator, as against the validity of the mortgage and the claims of appellants be taxed against such public administrator, and all other costs below equally between Moses Lobe Co. and M. George B. Appeal from Ascension parish. When manufacturers oblige themselves to furnish machinery to a planter of first-class material and workmanship and far from damaging defects, and guarantees the work for one year; and that ame shall be first evloted in their shops, aa far as practicable, Ju order that the planter, or his engineer may inspect the same before their delivery on board of steamboat at the port of New Orleans, for shipment to him, and on due notification he makes the Inspection and thereafter receives and uses machinery the burden of proof is on defendant to establish the following facts, viz That the workmanship and material were not of first class, but, on tne contrary, same were affected with aamaging defects. 2. To reconcile his "tpparens and implied acceptance of the mill tnd machinery, resulting from his ase of same in bearing off his crops, with his claim that some were In many essential particulars defective, both as to workmanship and material.

3. To establish by clear and satisfactory evidence that the mill and machinery had received lair usage" at his hands otherwise he can't defeat his contract to pay the prioe. 4. Holding under such a contract a large and valuable property, the defendant not having established the conditions precedent, is not entitled to delay proceedings for the purpose of having heard the evidence of his witnesses at to the quantum of damages. 6.

On Monday evening last, Mr. Alpuonse Philips, attorney for Edward Euderie.tlied a petition representing that John 8. Aitkens departed this lite in tals city, on the 30th ot May, 1687. Petitioner is the son-in-law of deceased, having married Mrs. Elizabeth Aitkens, who is also dead.

That from the issue ot the marriage petitioner has four children: Edward Albert, aged 21 years; Reuben, aged 15 years; Luclen, aged 12 years, and Annie, agea 17 years. He is the natural tutor ot his minor children, and bo prays tor the administration of the estate, his children being heirs of said deceased. The decedent left as his sole heirs 1. The children of A. Aitkens, his deceased son.

2. Tne children of Frank Aitkens, his deceased son. 8. Mrs. Mary Aitkena-Cumm-ings, wife of D.

J. CuummintB. 4. The children of Mrs. Elizabeth Aitkens-Enderle, the deceased wife of petitioner.

6. Miss Catherine Aitkens, now a sister of St. Joseph, and in religion known as Bister Angelica. Yesterday morning, Mr. Henry P.

Dart, of counsel for Mary E. Aitkens, wife of Daniel T. Cummiugs, filed a petluon, showing that John Smith Ailkens, father of first named petitioner, departed this life in this city on idav 30, 1887, ieaviDg an estate within the Jurisdiction of the court; that he owed debts, and an administration is necessary, ana petitioner makes application to be appointed administratrix of the estate; that deceased had a bank box at the Canal Bank, and petitioner believes that it contains a will, and an order should be Issued to the bank to produce the box for examination by the court, to ascertain if it contains a will that decedent left a Valuable personal estate, and it is proper that the seals snould be atlixed, pending further proceedings herein that decedent was married; that his wife died long belore him; that petitioner is one ot the heirs, and she is entitled to the administration over the applicant, who is not an heir of the decedent. it is prayed that an order issue to John Bendernagel, notary public, to a ills seals ana take an inventory; that the Canal Bank be ordered to produce the bank box belonging to John Smith Aitkens now in its possession that this application may be advertised and iu due course that petitioner be appointed administratrix of the succession, reserving her right to apply to be appointed dative, testamentary executrix of the will, if one should be found, and that the application by Edward Eudtrlee to be appointed administrator be denied. John MoClellan and Anderson Wright arrested for vagrancy, and McClellan for resisting arrest, were fined $20 or thirty days, and $10 or twenty aays respectively. Paul Danove tor beating Christian Ginger was placed under appearance bonds. Ed Williams, arrested on the complaint of Benjamin Franklin for obtaining money by falso pretenses, was discharged, but was fined 23 or thirty days as a suspicious character. Ida Brown, charged by Mrs. E.

Klley with petty larceny, was fined $10 or twenty days for pilfering. Mrs. A. Brigier, Mrs. Louts Durand and Pauline Foley were placed under peace bonds for Insult and abuse.

Frank Orfeld was fined $5 and placed under $250 peace bonds for insulting and abusing ana threatening Henry Walpern. Charies W. Dowllng as principal and Wm. Bowling and Richard Dowllng as accessories to the shooting and 'Founding of Geo. Klein, on the 18th of April, ou Carondelet Walk, between Broad ana Ltorgenois streets, were sent before the Criminal Court uuder $2Sd bonds each.
