15 Saturday, June 1, 1985 Stevens Point (Wis.) Journal Homes For Sale 440 LEGALS Homes For Sale 440 Homes For Sale 440 Farm Market 500 Auction Sales And Service Adjourn battery trial for two pro-wrestlers WAUKESHA, Wis. (AP) Two professional wrestlers accused of injuring city police officers in a motel melee last year had their trial adjourned for the weekend but the judge warned that any further delays will mean fines of "$100 for every five minutes they are late." Circuit Judge Roger P. Murphy adjourned the wrestlers' jury trial until Monday after warning the wrestlers and defense attorneys that they could face fines by the minute if they are not ready then. The charges against Masanori Saito, 41, of San Francisco and Kenneth Patera, 41, of Minneapolis stem from an April 6, 1984, incident in which they allegedly threw a female police officer against walls and knocked both her and a male officer unconscious before eventually being arrested. Saito, a former member of the Japanese wrestling team, is charged with three counts of battery to officers, one of obstructing an officer and one of resisting arrest.

Patera faces two counts of battery to officers, plus charges of obstructing an officer and criminal damage to property. "If either of the attorneys or Mr. Saito or Mr. Patera are not here Monday morning, I am prepared to fine them $100 for every five minutes they are late," Murphy said. "The court is not willing to plan its schedule around Mr.

Patera's wrestling schedule." Murphy's comments came after the defense attorneys, William Burke and Thomas Schultz, were not prepared to proceed. Murphy told the jurors just before they were excused Friday that he found it "most unfortunate" the defense attorneys, William Burke and Thomas Schultz, were unable to contin ue. Earlier Friday, a neurological surgeon testified that Officer Jacalyn Hib-bard received a severe but not life-threatening head injury in the fight. Dr. LaVern H.

Herman said Ms. Hib-bard sustained bruises and cuts about the face and head and neck injuries. He said a cerebral concussion had been caused by a blow to the officer's head that left her unconscious. Ms. Hibbard testified Wednesday that she has lost feeling on the left side of her face, that her vision has been blurred and that seven of her teeth were broken as a result of the fight.

The battle took place as police investigated an incident in which a rock was thrown through the window of a nearby fast-food restaurant. Andrew Killebrew, a Virginia man who was staying at the Waukesha Holiday Inn when the fight took place, said he watched as Ms. Hibbard and her partner, Officer John Dillon, "defended themselves" against an attack from Patera and Saito. Killebrew told the jury he noticed Ms. Hibbard was unconscious and dragged her from the hallway to the front lobby.

Sheriff's Sgt. David C. Bunker said the first officer he saw when he arrived at the hotel was Ms. Hibbard. "My first reaction was either she was knocked out or she was dead.

Her eyes were wide open and they were glazed," Bunker told the jury. "I felt there was nothing I could actually do for her and there were two others in a struggle at that time." Bunker said that, until enough men arrived, Saito "could pretty much do whatever he wanted to by moving his arms. There was no way we could physically restrain the man."
