TRIBUNE 7 Jury fo get vehicular homicide case The court's instructions and final arguments ot attorneys were being given Friday morning at the vehicular homicide trial of Jose Reyes, 20, 1481 10th St., in District Court. It was anticipated the case would go to the jury of six ·men and six women which has been hearing it before noon. Reyes is accused of operating a motor vehicle while under the influence of alcohol May 2,1976, resulting in Ihe death of Domingo Valezques Loza in a one-car accident on U. S. 85 north of Rockport. Judge Robert A. Bebrman is presiding at the trial, which began Wednesday. Larry Littlefield, Reyes' attorney, rested the defense's case about 4:30 p. m. Thursday after calling eight witnesses. Four of the witnesses gave testimony indicating Reyes was not the driver of the car when the fatal accident occurred. Henry Puente, 2223 8th Ave., the defendant's halfbrother, testified he had obtained hair samples from the wrecked vehicle at a salvage yard here several days after the accident. He said he had found some reddish colored hair embedded in the steering post of the vehicle. The sample was admitted as an exhibit. Elcazar Moreno, 1701 5th St., Reyes' brother-in-law,testified he had gone May 3,1976, to the Cheyenne hospital where the persons injured in the accident had been taken. He said he had visited with one of the injured men, Jose Alazan, and described Alazan as having light colored hair which appeared similar in color to the sample of hair Puente had found. Jim Jones, an investigator, said that, at .Littlefield's request, he had checked the wrecked vehicle last Sept. 1 and found three pieces of hair in the area above the steering wheel just before the windshield. He said the hair was much lighter in color than other hair found in the car. Joe Mar, 1028 6th St., testified that he had attended a dance at Cheyenne the evening before the accident and had seen Reyes dancing. Later he observed that Reyes had become very drunk and said, "I wanted to lake him home," adding (hat Reyes had been asleep at that time. He said before leaving the dance, he had discussed the situation with Reyes' companions and it iiad been determined that Alazan would drive Reyes' car back to Greeley. John McGown, deputy district attorney, rested presentation of the people's case at noon Thursday. People's witnesses who testified Thursday included two state patrol officers, Sgt: Ken Shiflet and Frank Holmes. Shiflel estimated the speed of the car involved in the accident was 109 miles when it went off the highway. Holmes testified that he had talked to Reyes about 10 a. m. the morning following the 2 a. m. accident and the defendant had said that he was driving the vehicle. He also said Reyes told him the car was going about 65 miles an hour at the time of the accident. A Fort Collins toxicologist, Dr. Dale Maag, testified for the people Wednesday that a blood sample allegedly taken from Reyes showed a .165 count. Anyone with a count over .100 is presumed to be drunk.
