GREELEY (Colo.) TRIBUNE State ruling on legal advertising asked By KON TOLLEKSON Tribune Staff Writer A letter has been sent from the county government to state officials, over the signature of Commissioner Glenn Billings, asking a legality ruling on county legal advertising of Die new Weld Charter. The letter cites four parts of state law that would appear to negate the broad charter standards. The letter, dated Wednesday, comes after the commissioners voted more than a week ago lo table 197G legal advertising bids including two from radio stations until a ruling could be obtained from the state attorney general's office. Addressed to Stale Local Affairs Director Betty Miller, with an information copy lo the governor's office, the letter seeks a legality ruling on this question: "Do we. as Weld County Commissioners, have the authority as purportedly granted lo us in Section 16-0 of Ihe Weld Counly Charter, to determine lhal 'other media' than legal publication newspapers as defined in the Colorado Stale Statutes, may carry legal notices and advertisements for the county, and to determine the form therefor?" sectiun of the new home rule charter dealing with legal advertising would broadly allow all media to compete for county legal advertising, under the choice of the commissioners.

The section states: defined otherwise in the ordinances, rules or laws pertaining to the procedure to which the public notice relates, public notice may be by publication in a newspaper of general circulation in the county or by such other media and in such form as may be prescribed by the The letter notes that Weld has received bids from "several 'legal publication' newspapers," but it adds that bids also have come from radio stations and from a newspaper not holding a second-class mailing permit, apparently Town and Country News of Greeley. In the letter, it is noted as one of the four references to state law that Colorado statutes require Hie holding of a second-class mailing permit as a criterion for being a "legal publication." Currently tabled by the commissioners are 1976 legal advertising bids from the Greeley Booster, Town and Country News, Greeley Journal, Windsor Beacon, Fort Lupton Press and from Greeley radio stations YOU and KFKA. Greeley Booster is apparent low bidder among the newspapers, and KYOU apparent low between the radio stations. The Billings' drafted after some legal research, notes: --That state law defines "legal notice" or "advertisement" as matter "required to be published in a -That stale law requires a "legal publication" to hold a second-class mailing permit. --That state law requires an affidavit proving legal advertising "was published in a newspaper duly qualified for that purpose." --That state law notes in cases in which legal advertising does not meet statutory standards," deeds issued by a County Treasurer are invalid."
