The Palladium-Item and Sun-Telegram, Richmond, Thursday, Nov. 17, 1960 15 What School Plan Must Include If 55 per cent of the registered voters sign a petition approving the new school corporation, it comes into being on July 1 or Jan. 1, whichever is earlier, following the date of the publication of notice by the county committee that all steps for the creation of the school corporation have been completed. The election method is used if no petition approving the proposed plan is received by the county committee within 90 days after state approval notice is received. The election method requires the county committee to notify the Circuit court judge that it has not received a petition of approval.

The judge then calls for an election on the plan with only registered voters within the boundaries of the proposed school cor poration eligible to vote. The election must be set for the primary or general election, whichever is earlier. Notice of any such elections will be published. Several Choices If the voters do not approve the proposed school plan the county committee has several choices: 1. It may do nothing, thus terminating the school corporation reorganization program in the county.

2. It may ask the Circuit court judge to resubmit the same plan at the next primary or general election. The law limits the number of elections on the same plan to two. 3. It may submit a new plan for school corporation reorganization county plan may be expressed in two ways by residents: 1.

By the circulation of a petition that requires the signatures of 55 per cent of the registered voters of the area within the proposed school corporations. 2. By a vote at a primary or general election at which a majority of the votes cast is required for approval. The signatures on any petition that might be more acceptable to the voters. This new plan would have to go through the same preliminary steps as the original plan.

If the plan calls for election of school board members, such an election must be held at the first primary following the creation of the school corporation. Nomination of members of the board must be by a petition signed by the candidate and 10 registered voters living within the school corporation boundaries. Public Hearings Prior to presenting the preliminary plan to the State School Corporation Reorganization commission, the county committee must hold public hearings throughout the county. Notice of the hearings must be published in advance, and the hearings must be open to the public. The reorganization plan will be discussed at the hearings and local residents given the opportunity to make suggestions. The 1959 reorganization law requires that the county committee explain the proposed reorganization plan, including the advantages and disadvantages the approval of the majority of the residents of the area affected.
