Taylor DEMOCRAT STAFF WRITER No one asked a Florida State University tutor to divvy out test answers to students.

But that's what happened during the fall 2006 and spring 2007 semesters. As a result, at least 50 student-athletes are being penalized. One athlete may be expelled and the tutor has been fired, FSU Provost Larry Abele said. "The issue is a little more complex than simply cheating," Abele said. "(It was) inappropriate assistance that wasn't requested." The tutor's actions have created a ripple affect.

Administrators have been forced to investigate the incident, report it to the NCAA because of the athletes' involvement and strengthen its policies regarding future online class tests. "(It's) frustrating. (It's) taking a huge amount of time to repair unnecessary damage," Abele said. An FSU athlete reported the tutor for giving out answers to tests earlier this year, prompting an investigation, Abele said. Over the two semesters, 900 students were enrolled in the online class.

However, the tutor was assigned to athletes, Abele said. FSU President T.K Wetherell declined to name the class, the instructor or the tutor. Charlie Crist's controversial casino compact with the Seminole Tribe until the Florida Supreme Court rules on the governor's authority to make the deal. A tribal spokesman said McCol-lum's request for an injunction won't have any impact on Seminole gaming because even if the pact was approved by the U.S. Department of Interior, the seven gambling sites won't have Las Vegas-style slot machines and "banked" card games for several months.

But the Tallahassee lawyer who helped negotiate the compact said McCollum is delaying a payment of $50 million that the Seminoles will make to the state upon federal approval of the agreement. In seeking a declaratory judgment from the U.S. District Court for the District of Columbia, McCollum pointedly took no position on the legality of the Indian Gaming Compact that Crist signed with the tribe last month.
