J. M. Stephens said Tuesday he was pleased with public reaction in this Texas border town to his stand on a sterilization operation he was stopped from performing in a Catholic hospital. The 36-year-old physician said he was "dismissed" last Friday from the staff of the Catholic Mercy hospital here for sterilizing a maternity patient. He said he considered the operation necessary from a medical standpoint.

He said he was stopped from completing the operation by a sister who walked into the operating room while he was closing the incision. He said the sister ordered him to until Fallopian tubes he had closed in the sterilizing process. Nun Denies Dismissal Sister Mary Stanislaus, in charge of the hospital's third floor operating room, denied that Dr. Stephens was dismissed. "He has been denied the use of the hospital for violating a national code of ethics established for Catholic hospitals in regard to these matters," she told the Brownsville Herald.

"The reaction has been so favorable that I will let the public carry the ball from now on," he said. The physician said the only reason he talked was that the hospital was the only one in this community and he thought "the people should know that they and their doctors do not have a free choice when they enter the hospital." Knew Of Violation Dr. Stephens said he knew he violated the hospital rule, but he did what he thought was best for the patient. He said it was an emergency Caesarean. The mother had a "hard time" in giving birth to three previous babies, he said.

"In my opinion sterilization was necessary," he said. "The woman and her husband had asked that it be done." In Texas, sterilization is permitted by a reputable physician for health reasons only and with the consent of parties concerned. The mother and baby were reported doing nicely. Dr. Stephens is a native of Los Angeles, Calif.
