1 Aug. 12, 1986 Paper, foundation challenge rape law Associated Press JACKSONVILLE The Florida First Amendment Foundation has joined a small Jacksonville weekly in challenging a state law that prohibits publishing or broadcasting a rape victim's name. The Florida Star, a weekly, violated the law on Oct. 29, 1983, when it printed 1 a victim's name in a police news column. The newspaper said the printing of the woman's name was a mistake.

A reporter -trainee copied the woman's name off a police report and then another reporter submitted the story under the category of "robberies," the newspaper said. The 33-year-old woman was sexually assaulted and robbed at knifepoint, the story said. She was awarded. $72,500 in damages from The Florida Star circuit-court jury found the newspaper negligent in December 1985. The newspaper is challenging constitutionality of the law before the 1st District Court of Appeal in Tallahassee.

While the ruling is being appealed, the Star does not have to pay the damages. The newspaper's attorneys said the U.S. Supreme Court has sided with the media in similar challenges in other states. Endorse From 1B Denise Prescod, the Star's attorney, said no case had challenged Florida's law the way this one does. Foundation attorney Paul Levine said Supreme Court opinions say the media can reveal anything found in public records, barring information that might endanger the public.

In this case, not printing the woman's name would have only saved her embarrassment. The woman's attorney, Joel Eaton, in a brief filed last week, said his client suffered "the ultimate invasion of her Peter Weitzel, foundation president and managing editor of The Miami Herald, said the Florida First Amendment Foundation thought the Star faced "a very difficult appeal and also a very strong possibility of facing financial difficulties if it lost the suit." Levine said the foundation is "not saying that newspapers want to be running around publishing the names of rape victims. No newspapers that I know of would do that indiscriminately with or without the statute on the books." But he said editors should decide whether to print a name and "a newspaper should not be punished particularly where the publication was accidental." Dumping plan blasted OCALA The state Department of Environmental Regulation is being criticized for its approval of a plan by the city of Ocala to dump up to eight-and-a-half-million gallons of treated sewage a day into the Oklawaha River.
