Luis Anthony Martinez, who is being charged as an adult, faces one count of attempting to commit second-degree murder, two counts of aggravated assault with a deadly weapon and one count of discharging a firearm.

He pleaded not guilty in May. Martinez was evaluated Oct. 18 by two mental-health experts at the request of his defense attorney, Clare Schum, according to court documents. Schum said in a Sept. 30 request that ability to assist counsel in his own defense appeal seemed to be impaired, and his ability to communicate raised concerns.

Maggi spent 103 days in the hospital with life-threatening injuries. Martinez was arrested about two weeks after the shooting, when police served a warrant at a residence connected to the teen.

As part of a plea deal, Julian Mendoza, 53, admitted to engaging in sexual acts with a 14-year-old boy four times in 2003.
