B16 - THE DESERT SUM, Pab Springs, Calif. Tuesday. December 20. 1983 Stardust casino president- charges 'baloney Pubfic Notices Pubik Notkes PublkNotkes Pubik Netkts Skimming - CARSON CITY, Nev, (AP) - Stardust hotel-casino president Al Sachs says it's unbelievable the state temporarily ousted him from his club in Las Vegas in its probe of alleged skimming of at least $1.6.million. "I can't in my wildest imagination think that some-" one could come in and just take my property arbitrarily," Sachs complained at a Nevada Gaming Commission hearing Monday on a complaint by its , investigative arm, the state Gaming Control Board. "This isn't Germany," said Sachs, adding, "If it's right, there's something wrong with the rules." He termed the state charges "baloney." . Sachs' lawyer, Mort Galane, also claimed a management team that took over from Sachs under a ' temporary supervisor arrangement has diverted business from the Stardust to other clubs. ' "They're taking my money and wrecking my joint," Sachs added. 4 Veteran gaming figures Bill Boyd, Perry Whitt and Charles Ruthe are now running the club, pending a final ruling by the Gaming Commission on the board's ' complaint alleging 22 violations and seeking a record S4 million in fines from the Sachs group. A ruling. on validity of the temporary supervisor arrangement was expected follQwing conclusion of the commission session Tuesday,- A commission hear-ing on the board's-complaint is scheduled Jan. 16. Galane also said the Control Board's chief counsel, . Jack Godfrey, admitted he had no "credible" proof that Sachs was tied to organized crime. According to an FBI affidavit; based on organized crime sources, Sachs and Stardust general manager Herb Tobman have fronted for Chicago! Mafia interests. However, the state's complaint doesn't accuse them of skimming but with failling to take "appropriate action" to stop the skimming. ' While insisting he took steps to, correct probfems pointed out by the Control Board last June, Sachs also No. 2724 FICTITIOUS BUSINESS NAME STATEMENT FILE NO. 83-6734 . Pandolfo is no longer present in the club, however. ' ' :Pandolfowas-recently ordered out of his job as - ibk seidi. Deputy assistant casino manager tonowing a state probe into allegations he was involved In a mob-related skim of Stardust profits. . ; Also during Monday's hearing, Stardust comptroller A'dolph Gutierrez conceded "minor" internal control violations occurred in recent months because "fill slips" used to order chips to gaming tables' were signed in advance. However, Gutierrez and Robert Wilgar, controlller of Trans Sterling Inc., Stardust's corporate parent," said steps were taken to correct problems' cited by Control Board agents last May. Gutierrez said he didn't consider it his responsibility to do any actual casino pit surveillance. And Wilgar said that while observations would help, they aren't "crucial." Gutierrez also said Sachs got him to deliver cases of fill slips dating back two years in apparent efforts to check for illegal skimming. "Stardust casino manager Louie Salerno-said he and Sachs reviewed the fill sips and watched television monitors in efforts to spot any skimming. Salerno also said a count on a blackjack table Dec. 2 showed no money was missing. An undercover FBI agent, Wayne Alexander, has stated a $25,000 fill of chips never arrived at the table.
