Page 20A I Wednesday, September Austin Judge Rejects Plea To Force Teachers' Hiring AUSTIN (AP) U.S. Dist. Judge Jack Roberts rejected a plea Tuesday by the Justice Department to force the Waco School District to hire teachers dismissed by the nearby La Vega schools. "To me this has all the earmarks of another effort to mess up the school system instead of allowing it to work smoothly," Boberts said. Roberts recently approved the Austin desegregation plan--calling for a minimum of busing-and rejected by an argument by the Health, Education and Welfare Department that Austin's plan failed to meet desegregation criteria.

That decision is on appeal. Some 66 teachers at La Vega were released when 1.207 pupils were transferred to the Waco schools after a change in school vtrict boundaries. The Justice Department lawyer, Bruce Davis, said only objective criteria--experience, degrees, national teachers' exam grade--may be used by Waco in determining whether to hire the La Vega teachers. Waco's lawyer, Tommy Herring, said subjective criteria also could be used, such as whether the teacher can maintain discipline in the classroom and cooperate with the administration, parents and other teachers. The Indian was Jimmy David Felihkatubbee, 32, who moved jio Dallas two years ago from I Oklahoma. Felihkatubbee's girl friend said he telephoned her twice at the Texas Instruments plant i last Thursday to make plans for la meeting at her apartment i Thursdav evening. She said that when she returned to her apartment from work, she saw Felihkatubbee's car and another car parked close together. Felihkatubbee's car apparently was being used to start the other car. The girl friend drove on by tubbee was in the back seat with a man.

Another man stood by Felihkatubbee's a and there was a woman nearby. The giri friend drope on by without speaking because she thought Felihkatubbee had been drinking and was trying to bring uninvited friends to her place. Looking outside later, saw Felihkatubbee motioning to her to come outside. She said she heard him say, "Call the police; they're going to kill me," The girl friend said she rushed to the automobile in which Felihkatubbee was being held and tried to free him. But she said a man holding Felihkatub- bee kicked her out.
