The governor Is an executive officer purely He neither make nor alter law. He cannot compel the legislature to obey Ms desires and he ib unable to do by edict what the legislature refuses to by law. He can advise the lawmakers of his opinions and beliefs; he can urge them to enact legislation giving the people power to settle such questions as the liquor by their votes, but if law- anakers decline to follow his suggestions, he has no more authority to nact the desired law than the hum- citizen.

It might be true that if Governor Brumbaugh could make laws or order elections, he would speedily have the of the several counties voting the question of local prohibition But since he is the servant of the constitution and not a maker of IP we must do what we can and then depend upon the force of public opinion persuade members of the general assembly to enact the desired legislation. Section 1. The Hill Top Street Railway company of Monessen when incorporated, and until such time the trustees hereinafter named, shall have the right and lawful authority to enter upon and construct, maintain and operate a single track of street railway with the necessary turnouts, switches and curves over the following streets or portions of streets in the Borough of Moneaoeri.

Beginning at a point on Borough line at the intersection of Luce avenue and Second street, thence in a notheily direction on and along Second street, to Knox avenue; thence in a westerly direction on and along Knox avenue to Rostraver thence westwardly and northwestwardly on and along Rostraver street to McKee avenue, thence eastwardly on and along McKee avenue to First St.jthence lortheastwardly on and along First itreet to the right-of-way of the P. E. R. R. Also beginning at a point on the Jast side of First street at Schoonmaker avenue; thence in an Easterly irection on and Schoonmaker to Ontario stieet; thence in a southerly direction on and along On- irio street to Indiana avenue; thence lastwardly on and along Indiana av- nue to Delaware street; thence in a Southerly direction on and along street to Shawnee avenue; ence continuing across Shawnee av- nue and in a southerly direction on along an unnamed fifteen foot wide alley to the Borough line.

Also beginning at a point on the North side of Donner avenue at Seventh street; thence in a Southerly direction crossing Donner avenue, and continuing on and along Seventh street to Schoonmaker avenue; thence Westwardly on and along Schoonmaker avenue to Ninth street, thence by curve on and along the low grade of Ninth street in a Westerly and Southerly direction to McMahan avenue; also beginning at a point on tne Westerly side of Eleventh street the road bed the rails and for a distance of eighteen (18) inches on each side thereof in gepd repair with the same material used by the Borough on the balance of the street Said company shall at all times keep the part of the street occupied by its lines in a passable condition. In the event that the streets or any part of them within the Borough limits or within or territory that may hereafter be annexed to the ough, shall be paved or repaved, the said comptny shall grade, ballast, pave or repave in like manner and with like material the said streets between the rails and for a distance of eighteen (18) inches on each side thereof, when and as the 'balance of said street so occupied shall be paved by said Borough, provided, that upon failure of said Railway company to make the necessaiy repairs within thirty (30) days after notice so to do, the Borough mav make such repairs it the cost of the Railway company. Section 4. In the construction and maintenance of said railway, a modern (9, inch trilby rail weighing not less than ninety-five (95) pounds per yard shall be used on Ninth street, Schoonmaker avenue, Seventh street, First street, McKee avenue and that portion of Rostraver street North of Reed avenue, and a seventy (70) pound A. The overhead trolley system shall be supported by span wires or brackets from wooden poles neatly painted, erected at the curb line on each side of the streets and highways, and the trolley wire shall at all times ar.d places be at least sixteen (16)feet above the top of the rail. The company in the construction and maintenance of its railway, shall not unnecessarily obstruct public travel, and the'street committee of the Town Courcil of the Borough of Monessen shall have the supervision of the instruction and maintenance of said ailway, and shall designate the loca- lon of the same on the said streets.

Section 5. The said company shall egin the construction of this road within two (2) years from the date of acceptance of this ordinance and 'hall have in opeiation cars within Borough limits within three (3) years from the date of the acceptance of this ordinance unless presented hy order of Court or other Causes beyond its control. Section 10 It is hereby understood and agreed that neither the purpose nor the intent nor the obligation of this contract, if and when approved by the Public Service Commission of the Commonwealth of Pennsylvania, is such as to impair or any wise Affect the exercise by said Commission of any of the powers vested in it by the Public Service Company Law approved July 26th, 1913.
