PAGE 6 TUCSON DAILY CITIZEN California Voted On 1 Tissues SAN FRANCISCO --UPI-- California voters yesterday gave residential property owners the absolute right to select or reject Negro tenants and buyers. The new constitutional provision, presented to the voters as Proposition 14, nullifies state open housing laws and prevents state and local government from enacting similar statute? in the future. Opponents headed by Gov. Edmund G. Brown quickly promised to carry their fight into the courts.

Last June, the California Supreme Court expressed "grave doubts" over the proposition's ability to survive a test under the U.S. Constitution. RETURNS showed nearly 2-1 approval for the measure. With 22,864 of 31,498 precincts reporting the count stood at 2,415,048 "yes" and 1,302,985 "no." The proposition was one of 17 on the ballot. In other major action, voters rejected a private corporation's plan to conduct a state lottery and approved a theater owners' request for a legal ban on pay television.

The privately operated lottery proposal, Proposition 16, came from the American Sweepstakes Corporation, which wanted to take 13 per cent of the gross under a 10-year contract with the state. Voters also approved Proposition 13, placed on the ballot by the legislature to combat the lottery proposal. The bond issues were contained in Propositions 1, 2 and 3. The first provides $150 million for beaches and parks and was similar to a measure rejected by voters in 1962. Proposition 2 provides $380 million for state construction, mostly at junior and state colleges and the University of California.

Proposition 3 provides $260 million to continue state loans and grants to local school districts for classroom construction.
