In a few minutes he heard the report of a gnn and then saw three men ride off. He idei lined the defendant as the man who fired the shot that tailed.

Cummins, ot Pottsboro, In this county, was next placed on stand, and that about desk, on the 10th day of October, 1SCS, he walking up North Travis street, when be berd what he thought to be gunshots In quick sncccssiau. He hurried to the scene, and found E. Jnnins Foster in dying condition from gunshot wounds in his side.

He told him (Cummins) that Jfowtoa Chance was the man who did it. Judge C. C. BinKley was next placed on the stand. He testified to having helped carry Potter to the office of the Sherman Patriot, which he (Foster) was at that time editing.

The prisoners were finally lodged in jail, and the commander of the guard fined by the alcalde for interfering with justice.

TO IBX SHERMAN, December special to tho Register says that two white men, well armed, were found dead within a few paces of ona another, near White Bead hill, Chlckasaw Nation, 200 miles north of thlsoity. The troops that were ordered to report for duty last night, did not leave for Bevier, as it was reported they would, and it Is hoped there will be no- occasion for them to go. The Striken BT. Loms, December special to the Post-Dispatch from Macon, says: There was firing of pistols and guns between the black and white miners at Bevier coal mines all last night, but without, serious injury to anybody. So far as can be learned, four men bve been killed siuce Saturday last--threo Degrees and one white man--besides several wounded. There is no abatement of feeling, and there is constant liability of bloodshed. Connty authorities have done nothing toward suppressing the riotous proceedings.

No militia have yet arrived. The women and children are being sent away from Bevier. Trouble is feared to night. A meeting of the citizens of Macon wis held this afternoon to take measures to restore order. Throe hundred stand of arms arrived this afternoon, and the sheriff is organizing a company.

The negro miners remain inside the stockade at the mine, and Ore at all the white miners who ccme within range of their guns. Every man and boy at the mines who able to handle a gun is said to be armed. The PrrrsBT'EGE, December striking miners of Monongabela have run up the white flag and no further trouble of a serious nature is anticipated. Special telegrams received tbis morning from a dozen or more points along tbe river, Indicate that the miners do not Intend to make another break as they did last week.
