Five faculty members have resigned this year and 22 others left between July 1, 1985, when Lundy became president, and Jan. 1 of this year, according to-a report in the Nicolet New Times, the campus newspaper. school's 125 employees, have requested a public hearing since the union called for the resignation of Lundy in June. Since that time, two faculty members have resigned, due in part to what they termed "intolerable conditions" at the school. But Zander said his board had heard no new allegation against Lundy and would not consider a public hearing at this time.

"The complaints we're hearing now are based on old facts," said Zander. "If new facts came forward, the board would take them into consideration and would go into a hearing. But I'm sure it would be a closed hearing. That's only fair to anyone when it involves a delicate issue such as this." Avery was given consecutive prison sentences totaling 32 years on charges of first degree sexual assault, attempted murder an false imprisonment as a repeater. Avery listed six major issues in his appeal and all were denied in a 16-page document issued by the 2nd District Court of Appeals. The prosecution's case was based largely on an identification of Avery by the victim through a photograph at a local hospital and later through an eight-man lineup at county jail. The court rejected defense claims that the evidence was insufficient to support the jury's determination that the sexual assault occurred only after they had found that he "had sexual contact with the victim by a threat to use a dangerous weapon." The victim testified during the trial that Avery threatened her with a knife although she never saw it. The assault occurred as the victim was jogging along the Lake Michigan shoreline north of Two Rivers.

Elliott, a former Chilton attorney, violated a state Supreme Court order issued last October revoking his attorney's license because of misconduct. Elliott was ordered to stafe in writing by Aug.

The City Building Inspection Department issued 25 single-family dwelling permits through July compared with 29 for the same period last year. There were also four duplex permits granted during each period. Dwelling costs for the first seven months were estimated at $1.6 million down from $1.8 million a year ago. "The single-family permits are running slightly behind 1986 and we expect them to stay pretty much along the lines of last year," said Deputy Director Wayne Huebner.
