Have there been delays? Is the right-of-way law a stumbling block to interstate highway construction in South Dakota? Conflicting reports have been heard in the recent months so the Argus-Leader addressed the following questions this past week to Charles J. Dalthorp, director, South Dakota Department of Highways. The questions and his answers: Q.

How many miles of Interstate have been built in South Dakota? Where? A. A segment of Interstate highway has been completed between Piedmont and a point north of Tilf ord, a total of 7.273 miles of highway at a cost of $1,831,490.56. The people of the Hills area have been driving on this stretch off Interstate highway for more than a year. Although this is not completely controlled access it is designed so controls can be established later. We are currently doing the preliminary design on the access control.

Often Ward must design plumbing fixtures to fit into a desired period. The state had 41.7 miles of Interstate construction under contract at that date but has placed another 5.5 miles under contract in September, for a total of 47.2 miles. SOUTH DAKOTA RANKS SEVENTH in the nation for miles of Interstate highway completed by Aug. 31 of this year, according to the Bureau of Public Roads of the United States Department of Commerce.

The above chart was drawn from official statistics released by the Federal Bureau of Public Roads. At the time of the progress tabulation, South Dakota had completed 97.3 miles of highway with Interstate funds. There is no question but what we will be ahead on lettings by the end of the fiscal year of 1958-59. South Dakota is one of the few states in the Midwest that allocated a portion of the additional emergency federal funds in the amount of $7,209,019 made available for general highway in April, 1958, to its counties for secondary road construction. The state of South Dakota made an allocation of more than one million dollars to the counties out of a total secondary road allocation of slightly less than two million dollars. Our primary, urban and secondary program for 1958-59 is 68 per cent under contract. The crash program manv miles under contract.

Full appraisals for right-of-way acquisition have been made on all of the property involved in this segment. Purchasing of right-of-way has been under way for the project for several weeks. The plans for the Interstate extending from north of Highway 38A on Highway 77 (Holger Anderson Corner) to the Minnesota line are complete. Our appraisers are just completing their work on the strip from Highway 11 to the Minnesota line. The strip of Interstate highway from approximately 4 miles east of Wicksville to two miles west of New Underwood, totaling 18 miles in an amount of approximately $7,335,000, is nearing the plans completion stage. These figures reveal that this state has been challenged with more than twice the ordinary Interstate allotment in 1957-58 and almost three times the ordinary Interstate allotment in 1958-59. These allotments are made on a three-year basis, which meens that the money from the 1957-58 program will expire on June 30, 1960, and the allotment for the 1958-59 program will expire on June 30, 1961. There is absolutely" no question but what we will have used these allotments well ahead of the expiration date. Fluctuations between allocations on Interstate from year to year tend to create a feast one year and a famine the next year. Q.

What are the state portions for the fiscal years 1957-58 and 1958-59? A. Fiscal year 1957-58, $1,899,559. Fiscal year 1958-59, $2,234,641. Time magazine sometime ago indicated we are having divficulty in building the Interstate because of financial limitations. This is a misstatement.

South Dakota is one of the few states in the United States that does not have a right of entry law. Because of this' inadequacy the state must depend on the federal government for right of entry. Right-of-way problems have delayed letting to contract. Similar problems confront the state on most Interstate lettings. A right of entry bill will be introduced in the next legislative session. Q. Gov.

Foss said some time ago highway projects would be scaled into smaller projects so small contractors would have a chance to get highway contracts. Has this practice been followed? If answer is yes, cite examples. If answer is no, why not? A. In all Interstate lettings, we have broken the projects down in such a manner as to give all types of contractors an opportunity to bid. For instance, in the Sioux Falls west Interstate that was was let on Sept.
