"We were told by people familiar with the situation in Sunrise that these people would be the best if we needed help," McKettrick said. After the nursing home approvals, McKettrick and partner Thomas Allgood, a Georgia state senator, formed a new corporation and proposed a $4-million medical office building next to the nursing home.

The office building is to be built on the same property, but required rezoning from residential to business. McKettrick said that for the office project he hired Montgomery's consulting firm Associates "as kind of a liaison." McKettrick said he again hired Leibowitz as a lobbyist. "I'm a government consultant and that's what I do," Leibowitz said. He said his new fee hasn't been set because it's unclear whether Richmond will continue to need his services. "They still have to work out their financing," he said.

"They may be applying for revenue bonds." McKettrick confirmed that the new fees for both Montgomery and Leibowitz were still being negotiated. The office rezoning came before Sunrise City Council in July and August, and Montgomery voted both times for the project. However, he did not file the required forms disclosing the voting conflict. The penalty for failure to disclose conflicts ranges from public reprimand to removal from office. Montgomery's partner in both the real estate firm and consulting firm is Robert T.

O'Keefe who also is chairman of the Sunrise Planning and Zoning Board. The office building rezoning was approved without opposition, but the Richmond nursing home drew strong neighborhood opposition. From the beginning, Montgomery was a major booster of the nursing home. When he introduced the project to the City Council in October 1981, he went to a map on the wall to point out the location of the property for which he was the real estate broker.

In May 1981, Richmond Health Care had told Montgomery to explicitly state in the purchase contract that the $739,200 sale depended upon first obtaining "zoning approval as well as any required building and safety permits." Richmond also told Montgomery the purchase depended upon obtaining favorable long-term financing and Montgomery at the October meeting strongly advocated that the city sponsor industrial revenue bonds to finance the nursing home. "I am asking this council to consider the merits of this project," Montgomery said. "Forget, for a moment, forget my involvement in it." The council approved the revenue bonds and voted in favor of the nursing home five more times in late 1981 and early 1982 to approve site plans, grant an exception to zoning laws and complete the $7.5 million bond sale. In the initial debates, neighborhood residents angrily protested the nursing home and hired lawyer Mark Jacobs to represent them. "Montgomery was the broker and had a vested interest; they pushed it right through," Jacobs said.

Broward officials, who hope to enlist the aid of U.S. Rep. E. Clay Shaw, R-Fort Lauderdale, in passing the bill, don't expect obstacles. If the bill is passed and signed by President Reagan, state officials said they want to begin buying land in the path of the expressway route by next summer.

The Broward County Planning Council recently designated the so-called missing link of the port route as an expressway corridor, limiting development to keep down future public purchase costs. Officials credit Chiles with bringing about the federal regulation changes that make the allocation of transit dollars possible. According to those familiar with the legislation, Chiles' amendment allows federal interstate repair funds generated by the April 1 gasoline tax increase to be used for building roads not eligible for primary interstate funds.

McCue said Florida's share of those new gas tax dollars was going to jump from $24 million in 1982 to $100 million by 1986, but the Port Expressway's status as an unfunded interstate highway prevented using the new funds on it until the Chiles amendment was approved.
