The controversy over lost revenue from Hollywood Inc. began in September when Councilman Alan Pen-berthy discovered an agreement be-' tween the city and Hollywood Inc. that required the developer to spend a minimum of $80,000 in building and permit fees during the 1981-82 fiscal year, Penberthy said he was told by the Building Department that Hollywood Inc. had paid the city $73,000 less than the guaranteed $80,000 minimum.

During a recent City Council meeting, Penberthy demanded Hollywood Inc. pay the city the $73,000 immediately in order to reduce the amount of money taken from the city's contingency fund to offset the budget deficit in the nest fiscal year. A representative of Hollywood Inc. who appeared at the meeting offered to pay the city $10,000 in lost interest on the money, which the city accepted. Both sides agreed to have the proper paperwork drawn up by their attorneys.

But during the next few days, a mistake was discovered in the calculations. "The Building Department gave me the wrong information," Penberthy said. After reviewing the figures, someone in the Building Department discovered Hollywood Inc. had paid almost all of the guaranteed $80,000 during the fiscal year. Permits for a residential community in Rock Creek paid for by Hollywood Inc.

on Oct. 12 brought the figure up to the $80,000 mark, Penberthy said. "If they (the Building Department) had given us the right information, we would not have had this controversy," Penberthy said. He said the situation, however, has shown city officials they ought to look more closly at the agreement signed by all developers.
