Paul Beermann and Frank Brooks (representing the City Water Department) stated there are two City wells. In the general area and that City funds have been expended drill test holes to determine the available water supply In Avra Valley, In which the City has made public commitments to serve domestic water consumers.

During the ensuing discussion among the Board members, the County Engineer, and the aforementioned persons, Mr. Beermann in answer to questions from the Special Deputy County Attorney (Robert N. Hillock) asserted that the City proposes to serve outlying areas to help amortize Ihe cost of bringing water lo Ihe City. He added that me water problem is a common one and that the petitioned area should be considered a part of metropolitan Tucson. Mr.

Scruggs called attention to the fact that his client's land -is between fifteen and twenfy miles from Ihe present City boundary and that the area cannot be annexed until it is contiguous to existing City limits. Mr. Brooks expressed his opinion that because it is not feasible to develop the approximate. 5,000 acre petitioned area as one unit it Is pre-. mature to franchise the entire area at this time.

Mr. Scruggs pointed out that the question before the Board is whether lo grant a franchise to permit the use of existing and possible future roadways for the purpose of Installing a water system and to serve consumers In.an area proposed to be developed by his client, who will obligate himself to install a water system as the first stage of a multi-million dollar development. -On consideration, it was moved by.Mr. seconded by Mr. Jay, and.

1522, of Camino Escuela northerly from River Road to the intersection of the established roadway with the east line of the SW'ANW'A of Section 20, T. 13 R. 14 E. The County Engineer reported that the petition, which was filed with the Board before it had been checked by his department, proposed to relocate that portion of Camino Escuela petitioned to be abandoned under Proceedings No. 1519 (Item 13).

He stated, in answer to questions from the Chairman, that the most effective procedure to realign the roadway the Interested persons to submit a deed lo Ihe Board and to open and construct Ihe road; then, the Board can complete abandonment proceedings. Inasmuch as there is no necessity for establishing this small portion of Camino Escuela, recommended that the petition be denied. In answer to further questions from the Chairman, the Special Deputy County Attorney explained that the segment involved Is so short that rather than accomplish the relocation through establishment proceedings the County Engineer recommends that right of way be conveyed lo the County by deed and that the realignment to constructed as Is customary fn other subdivisions.
