After Yost stopped the car, Miss Johnson resisted arrest, striking him on his arm, he said. White admitted hitting Banks after being provoked, but he denied using any weapons. In another case involving a fracas in a Williamsburg nightclub, Cornell Doughty, 21, of 81st Newport News, had a maiming charge reduced to an assault and battery conviction. He was ordered jailed Monday until July 3 and a presentence report was set for July 28. The victim and prosecution witnesses identified Doughty as the man who assaulted the victim, resulting in a broken nose, three teeth knocked out and other teeth chipped. Doughty testified he only defended a companion who was fighting with another man.

An examiner who administered a lie detector test requested by Doughty testified he seemed to be lying on four of five questions about the incident. WILLIAMSBURG A fracas in Williambsurg's Triangle block March 27 resulted Thursday in a misdemeanor and a felony conviction against a James City County man. Leon White, 23, of Route 657, was jailed pending a presentence report June 29 in Williamsburg-James City County Circuit Court. Judge Russell Carneal amended two original maiming charges against White to assault and battery of one victim and "unlawful, but not malicious maiming" of another man. In an appeals trial heard simultaneously, Carneal upheld a district court conviction against Patricia Johnson of Toano of assaulting and battering a police officer.

She was sentenced to 60 days in jail, with 58 days and fined $50. Milton Banks, 26, of Route 1, James City County, testified White struck him with his fist and knifed him several times. Herman Byrd, 23, of Toano, said White hit him with brass knuckles, stabbed him, and stomped and kicked him with other assailants. An emergency room doctor's report indicated both men suffered puncture wounds. Byrd had a fractured jaw and was hospitalized for three days.

Couple Sentenced For Assault By RICH METCALF Staff Reporter YdRKTOWN York County's central accounting records have been reshuffled in the past months to meet the recommendations of state auditors.

The reshuffling involved general accounting practices such as balancing all accounts with the county's general ledger and immediately posting budget changes authorized by the county supervisors. Other recommendations met by the county's accounting and budget department include providing on a monthly basis financial statements to the supervisors and each county administration department director. The recommendations were made in a report by Charles K. Trible, state auditor of public accounts, on the state's most recent overhaul of county finances. Several other recommendations have not yet been met.

They include bringing up to date every month central accounting records with those in the county treasurer's office. In addition, the state auditors recommended the treasurer's office be kept up to date on the finances of the county's fiscal agents. The agents are regional organizations whose budgets are processed by the county. Both Accounting and Budget Director Bob E. Wolfson and Treasurer A.

Glenn Page said communication on record keeping has improved since the recommendations were made. Wolfson said he expects the recommendations to be met by the end of this month. Trible's recommendations were made public in January. They resulted from an audit of the county's finances for the fiscal year ending June 30, 1977. The recommendations were based primarily on the central accounting records for the last five months of the fiscal year, February through June.

The audit report said the records "had not been maintained in an accurate and timely manner." Those five months were a period of several personnel changes in the budget and accounting office. John Mahaffey, assistant county administrator in charge of accounting, resigned that May. The audit report said the county's records "generally had been prepared in very good order." Contest Winners WILLIAMSBURG Miss Rita Bartlett, a member of Mt. Pleasant Baptist Church in James City County, has won the local Miss National Association for the Advancement of Colored People Youth Contest. Leroy Smith of Grafton Baptist Church in Yorktown has won the title of Mr.

NAACP. Miss Bartlett and Smith will participate later this year in state competition. Runners up for the Miss NAACP title were Miss Rosezella Ransome of Grafton Baptist and Miss Donna Lewis of St. John Baptist Church in York County. Mr.

NAACP runners up were Walter Brown of St. John and Wendell Brown of Mt. Pleasant, The local youth contest is sponsored annually by' the Youth Council of the NAACP's York-James City-Williamsburg branch. New Cities After Gold Strikes JUNEAU Alaska has had several gold rushes, starting with a find in 1880 by Joe Juneau and Richard Harris that led to the founding of Juneau. Nome and Fairbanks also owe their founding to gold strikes.

Lawyers, Robert Hatton of Norfolk and Gene Locks of Philadelphia, told U.S. District Judge Rich-' ard Kellam the documents show the defendant in the case, the Johns-Manville committed fraud under Virginia law by failing to warn Dishner and his supervisors. "It's a fraud that began 1949," Hatton said. But the lawyers for Johns-Manville, which is being sued for a total of $3 million by the Dishner estate, maintained the trade association minutes miss a necessary element in the proof of fraud evidence the firm made efforts to conceal the information, if it existed. "They still have yet to produce evidence to show that Johns-Manville took an affirmative step to conceal.

All that (the document) is irrelevant at this point," countered an attorney for the company, C. Michael Montgomery. Kellam denied the admission of the minutes and told Dishner's lawyers they could not introduce any evidence as to fraudulent concealment. Much of the rest of the fourth day of the trial before Kellam and a U.S. District Court jury was taken up with the reading of a deposition Dishner gave before he died last December from the disease mesothelioma.

The 58-year-old pipefitter said he had worked with asbestos for about five years and never was warned it was hazardous. Mesothelioma is a fast-spreading cancer that most commonly forms on the pleura, a sac enveloping the lungs. There is no known cure for the disease, which has been linked to the inhalation of asbestos fibers. More than 100 workers at the Norfolk Naval Shipyard in Portsmouth, the Newport News Shipbuilding Dry Dock Co. and the Allied Chemical Corp.

plant in Hopewell have sued asbestos manufacturers, but Dishner's is the first to come to trial. In return, more than 30 asbestos manufacturers have sued Newport News Shipbuilding for $60 million and also have sued the federal government. The Dishner suit will resume Friday morning. YORKTOWN A James City County husband and wife were sentenced to jail for assaulting two York County sheriff's deputies and two operators of a restaurant here. Hershel L.

Hyatt 27, and Suzanne Hyatt, 19, both of Chickahominy Outpost Trailer Park, been found guilty on charges stemming from a May 26 fracas at the Spectrum Restaurant on Water Street. Hyatt was sentenced to 12 months in jail on each of four charges. Six months of each concurrent jail term was suspended for two years on condition he pay restitution and stay away from the Spectrum. He was also fined $100 on each charge and assessed court costs. Mrs.

Hyatt also was sentenced to 12 months on each of three charges. Eight months of each concurrent term was suspended for two years on condition she pay restitution and stay away from the Spectrum. She was fined $50 on each charge and assessed court costs. Hyatt assaulted Deputy Rex Sulik "with his hands and his feet and his head," according to the warrant. He also assaulted Nick Concilus II and his son, Nick Concilus III, operators of the Spectrum.

In addition to the three counts of assault and battery, Hyatt was found guilty of impeding a law officer while doing his duty. Mrs. Hyatt also assaulted Sulik, whom she hit in the face with her shoe. She also assaulted Deputy Larry Firman and also was found guilty of impeding an officer. The fracas began when the couple was refused service at the restaurant.

The assaults occurred both at the restaurant and later at the sheriff's office. In other York County General District Court action, two York County men were each found guilty of assaulting a woman in unrelated incidents. Hugh B. Jamerson 19, of Mooretown Road, was fined $25, assessed court costs and given a 30-day jail term suspended for one year on condition of good behavior. Jamerson was convicted of assault and battery for attacking with a stick a woman, also of Mooretown Road.

Jamerson was ordered to pay $40 restitution. Charles R. Thomas III, 18, of Woodland Trailer Court at Grafton, was fined $50, assessed court costs and given a two-day jail term for assaulting with his hands a Seaford woman. Thomas was fined $25 and assessed court costs on a related conviction for using abusive language. Iverson Gary, 41, of East Gate Apartments, Route 143 in York County, was fined $100 and assessed court costs on a conviction for operating a vehicle with a revoked driver's license.

Gary also was sentenced to 30 days in jail, with 28 days suspended for one year on condition of good behavior. He was arrested April 24 near his residence. i Harry Glen McNutt, of Laurel Drive in Hampton, was fined $100 and assessed court costs on a conviction for driving a car with a suspended license. McNutt also was sentenced to 30 days in jail, with 28 days suspended for one year on condition of good behavior. He was arrested March 3 in Poqouson.

Glo-Co WILLIAMSBURG A Vietnam veteran who was "shot out of the air 12 times" by enemy fire was granted a continuance Thursday on a charge of driving while being declared an habitual offender. A defense attorney argued, "I don't believe his Honor (Judge Russell Carneatr a former state delegate) had in mind when he was in the General Assembly" to punish someone like William Musselwhite, 43, under Virginia's habitual offender statutes. Musselwhite, of Rich-wine Drive, York County, had been declared an habitual offender after two drunk driving Convictions in York County in 1974, soon after leaving the service. As a mechanic, he served on recovery teams for aircraft downed behind enemy lines. In emotional testimony in Williamsburg-James City County Circuit Court, Musselwhite said he decided then that he had a drinking problem and has not been drinking since.

But on Feb. 26, city police officer Chris Bowman saw Musselwhite driving and stopped him. There was no emergency, Musselwhite admitted. It was Sunday morning, and he was on his way to a donut shop for donuts and a newspaper. The owner of the donut shop, where Musselwhite had moonlighted, said he had been a hardworking employee.
