Mann, administrator of the estate of Gertrude Mann, deceased, vs. tho Homo Insurance compnny of New York, was filed in United States District court in Cincinnati, from Butler county court 'of common pleas, by the defendant. In this action, recovery of, $4,500, with interest from September 18, 1028, is sought under an automobile theft insurance policy issued by the company to Gertrsdo Mann.

It is alleged the automoMlo was stolen on September IS, 1028, and that due notice was given to the coinpany of tho loss. DELAY SENTENCE OF BUCKLEY Dayton, Ohio, Mar. 11 Bert B.
