The defense then moved for change of venue for Boyd to the northern district of federal court in this slate on the ground, among other things, that Boyd's home was situated at Aberdeen. Byron S. Payne, assistant U.

On request of defense counsel, more time was allowed in which to augment the showing for change of district. Boyd and Allchin were arrested by federal officers last January at McCook on the charge of falsely Impersonating a United States officer. They are alleged to have attempted to defraud Mrs.

Patrolman Torrey's will was in a sealed envelope in a safe deposit box which was in an unlocked cabinet safe. The burglars ransacked the safe, found nothing, then pried open the policeman's box ana examined his private papers. On top was his will in a sealed envelope. They ripped open the envelope and examined the contents.

Battering the dial off a heavy safe at the Edwards Finance company, 205 Minnehaha building, other thieves found $170 in currency Sunday. Engstrom explaned that Butte county, which owes $10,000 in interest on school fund loans and cannot make a supplemental budget, is not the only county which has not paid its obligations to the state. "There are some six or eight counties that have not yet made their pavment," he said, "but every effort is being made by the commissioners to take care of it as soon as possible. While I fully realize the financial difficulty in several counties in the state, Mr. Seward could hardly expect this department to advocate or encourage direct violation of the state's statutes and its constitution." Don't Force Loans Repeating a statement that his department does not force school loans on counties, Mr. Engstrom explained that the law requires counties to advertise for loans only when there Li a surplus in the school fund.

He said this condition has never existed during his term of office and that his department has requisitions from the county auditors "for ten times the amount that we can supply." The commissioner added that the department's loaning operations "during the last year have been confined to special cases where some farmer is about to lose his home by foreclosure to some loan corporation, where the county commissioners and the borrower have petitioned for special consideration, apd with our limited funds we have not been able to take care of all of these."
